H.F. 2210 Section 1. Section 135B.7, Code 2024, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 6. The department shall also adopt 3 rules prohibiting hospitals and rural emergency hospitals 4 from including on an application for clinical privileges a 5 question regarding whether the applicant has a past history or 6 diagnosis of mental illness, substance use disorders, or other 7 physical or behavioral health conditions. The rules shall 8 allow hospitals and rural emergency hospitals to include on 9 an application for clinical privileges a question regarding 10 whether the applicant currently has any condition that is not 11 being appropriately treated which impairs or adversely affects 12 the applicant’s ability to practice with reasonable skill and 13 safety in a competent, ethical, and professional manner. 14 Sec. 2. NEW SECTION . 147.4A Applications —— current 15 impairment. 16 A board shall not include on an application for licensure 17 or renewal of a license a question regarding whether the 18 applicant has a past history or diagnosis of mental illness, 19 substance use disorders, or other physical or behavioral 20 health conditions. A board may include on an application for 21 licensure or renewal of a license a question regarding whether 22 the applicant currently has any condition that is not being 23 appropriately treated which impairs or adversely affects the 24 applicant’s ability to practice with reasonable skill and 25 safety in a competent, ethical, and professional manner. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill relates to applications for clinical privileges 30 to practice at a hospital and for licenses for health-related 31 professions. The bill requires the department of inspections, 32 appeals, and licensing to adopt rules prohibiting a hospital 33 or rural emergency hospital from including on an application 34 for clinical privileges a question regarding whether the 35 -1- LSB 5154YH (5) 90 ss/ko 1/ 2
H.F. 2210 applicant has a past history or diagnosis of mental illness, 1 substance use disorders, or other physical or behavioral 2 health conditions. The rules shall allow a hospital or rural 3 emergency hospital to include a question regarding whether 4 the applicant currently has any condition that is not being 5 appropriately treated which impairs or adversely affects the 6 applicant’s ability to practice with reasonable skill and 7 safety in a competent, ethical, and professional manner. 8 The bill similarly prohibits licensing boards for 9 health-related professions from asking about an applicant’s 10 past history or diagnosis of mental illness, substance use 11 disorders, or other physical or behavioral health conditions. 12 The bill allows licensing boards for health-related professions 13 to ask whether the applicant currently has any condition that 14 is not being appropriately treated which impairs or adversely 15 affects the applicant’s ability to practice. 16 -2- LSB 5154YH (5) 90 ss/ko 2/ 2
