H.F. 2200 Section 1. MEDICAID HOME AND COMMUNITY-BASED SERVICES 1 INTELLECTUAL DISABILITY WAIVER ELIGIBILITY —— DIAGNOSIS. The 2 department of health and human services shall amend Medicaid 3 member eligibility criteria for the home and community-based 4 services intellectual disability waiver to authorize, in 5 addition to psychologists and psychiatrists, pediatricians, 6 behavioral health providers, advanced practice registered 7 nurses, advanced registered nurse practitioners, and other 8 advanced practice providers to diagnose a person as having 9 an intellectual disability. Any authorized health provider 10 shall have the requisite knowledge, training, and expertise 11 to diagnose an intellectual disability and shall utilize an 12 evidence-based diagnosis tool approved by the department. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill relates to the diagnosis of an intellectual 17 disability for the purposes of eligibility for the Medicaid 18 home and community-based services (HCBS) intellectual 19 disability waiver. The bill requires the department of health 20 and human services (HHS) to amend Medicaid member eligibility 21 criteria for the HCBS intellectual disability waiver to 22 authorize, in addition to psychologists and psychiatrists, 23 pediatricians, behavioral health providers, advanced practice 24 registered nurses, advanced registered nurse practitioners, 25 and other advanced practice providers to diagnose a person 26 as having an intellectual disability.
