H.F. 210 Section 1. Section 272.2, subsection 14, paragraph b, 1 subparagraph (2), Code 2023, is amended to read as follows: 2 (2) The applicant is less than twenty-one years of age 3 except as provided in subsection 26 and section 272.31, 4 subsection subsections 1 and 4 . However, a student enrolled in 5 a practitioner preparation program who meets board requirements 6 for a temporary, limited-purpose license who is seeking to 7 teach as part of a practicum or internship may be less than 8 twenty-one years of age. 9 Sec. 2. Section 272.2, Code 2023, is amended by adding the 10 following new subsection: 11 NEW SUBSECTION . 26. Adopt rules under chapter 17A 12 establishing a license for substitute teachers. The rules 13 shall authorize the board to issue a substitute license to an 14 individual who is at least twenty years of age that allows the 15 individual to substitute in grades prekindergarten through 16 eight. 17 Sec. 3. Section 272.31, subsection 4, Code 2023, is amended 18 to read as follows: 19 4. The board shall issue a substitute authorization that 20 allows an individual who is at least twenty years of age to 21 substitute in grades prekindergarten through twelve eight, 22 and an individual who is at least twenty-one years of age to 23 substitute in grades prekindergarten through twelve, for no 24 more than ten consecutive days in a thirty-day period in one 25 job assignment for a regularly assigned teacher who is absent, 26 except in the driver education classroom. A school district 27 administrator may file a written request with the board for 28 an extension of the ten-day limit in one job assignment in a 29 thirty-day period on the basis of documented need and benefit 30 to the instructional program. The executive director of the 31 board or the executive director’s designee shall review the 32 request and provide a written decision either approving or 33 denying the request. A substitute teacher authorization shall 34 require not less than the successful completion of an associate 35 -1- LSB 1890YH (2) 90 jda/jh 1/ 2
H.F. 210 degree or not less than sixty undergraduate semester hours, 1 or the equivalent, from a college or university accredited by 2 an institutional accrediting agency recognized by the United 3 States department of education. 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 This bill relates to substitute authorizations and licenses 8 issued by the board of educational examiners (BOEE). Current 9 law requires the BOEE to disqualify an applicant for a license 10 if the applicant is less than 21 years of age, with certain 11 limited exceptions. The bill authorizes the BOEE to issue a 12 substitute authorization or license to an individual who is at 13 least 20 years of age that allows the individual to substitute 14 in grades prekindergarten through eight. 15 -2- LSB 1890YH (2) 90 jda/jh 2/ 2
