NEW SECTION . 139A.8C Enforcement of immunization 1 and vaccine requirements. 2 Notwithstanding any provision of law to the contrary 3 requiring a person to receive a specific immunization or 4 vaccination, such requirement shall not be enforced unless 5 the United States food and drug administration approves and 6 licenses the immunization or vaccine and the department of 7 health and human services approves the immunization or vaccine 8 based on a determination that the immunization or vaccine is 9 safe and effective for its intended use, that the immunization 10 or vaccine is effective in preventing infection and the 11 transmission of disease, that the benefits of the immunization 12 or vaccine outweigh the risks for those who are likely to 13 receive the immunization or vaccine, and that the manufacturing 14 process for the immunization or vaccine ensures product quality 15 and consistency. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill relates to the enforcement of immunization and 20 vaccine requirements. 21 The bill provides that notwithstanding any provision of 22 law to the contrary requiring a person to receive a specific 23 immunization or vaccination, such requirement shall not be 24 enforced unless the United States food and drug administration 25 approves and licenses the immunization or vaccine and 26 the department of health and human services approves the 27 immunization or vaccine based on a determination that the 28 immunization or vaccine is safe and effective for its intended 29 use, is effective in preventing infection and the transmission 30 of disease, its benefits outweigh its risks for those who 31 are likely to receive it, and the immunization or vaccine 32 manufacturing process ensures product quality and consistency. 33 -1- LSB 5236YH (5) 90 pf/ko 1/ 1
