H.F. 2031 Section 1. Section 256.11, subsections 3 and 4, Code 2024, 1 are amended to read as follows: 2 3. The following areas shall be taught in grades one through 3 six: English-language arts, social studies, mathematics, 4 science, health, physical education, traffic safety, music, 5 visual art, and, subject to section 279.80 , age-appropriate and 6 research-based human growth and development. Computer science 7 instruction incorporating the standards established under 8 section 256.7, subsection 26 , paragraph “a” , subparagraph (4), 9 shall be offered in at least one grade level commencing with 10 the school year beginning July 1, 2023. The health curriculum 11 shall include the characteristics of communicable diseases. 12 The state board as part of accreditation standards shall adopt 13 curriculum definitions for implementing the elementary program. 14 The human growth and development curriculum shall include all 15 of the following: 16 a. Human biology related to pregnancy. 17 b. Human development inside the womb. 18 c. A high-definition ultrasound video, at least three 19 minutes in duration, showing the development of the brain, 20 heart, sex organs, and other vital organs in early fetal 21 development. 22 d. A high-quality, computer-generated rendering or 23 animation, comparable to the meet baby Olivia video developed 24 by live action, showing the process of fertilization and 25 every stage of human development inside the uterus, noting 26 significant markers in cell growth and organ development for 27 every significant marker of pregnancy until birth. 28 4. The following shall be taught in grades seven and 29 eight: English-language arts; social studies; mathematics; 30 science; health; age-appropriate and research-based human 31 growth and development; career exploration and development; 32 physical education; music; and visual art. Computer science 33 instruction incorporating the standards established under 34 section 256.7, subsection 26 , paragraph “a” , subparagraph (4), 35 -1- LSB 5035YH (7) 90 jda/jh 1/ 4
H.F. 2031 shall be offered in at least one grade level commencing with 1 the school year beginning July 1, 2023. Career exploration 2 and development shall be designed so that students are 3 appropriately prepared to create an individual career 4 and academic plan pursuant to section 279.61 , incorporate 5 foundational career and technical education concepts aligned 6 with the six career and technical education service areas as 7 defined in subsection 5 , paragraph “h” , incorporate relevant 8 twenty-first century skills to facilitate career readiness, 9 and introduce students to career opportunities within the 10 local community and across this state. The health curriculum 11 shall include age-appropriate and research-based information 12 regarding the characteristics of sexually transmitted diseases. 13 The state board as part of accreditation standards shall adopt 14 curriculum definitions for implementing the program in grades 15 seven and eight. However, this subsection shall not apply to 16 the teaching of career exploration and development in nonpublic 17 schools. The human growth and development curriculum shall 18 include all of the following: 19 a. Human biology related to pregnancy. 20 b. Human development inside the womb. 21 c. A high-definition ultrasound video, at least three 22 minutes in duration, showing the development of the brain, 23 heart, sex organs, and other vital organs in early fetal 24 development. 25 d. A high-quality, computer-generated rendering or 26 animation, comparable to the meet baby Olivia video developed 27 by live action, showing the process of fertilization and 28 every stage of human development inside the uterus, noting 29 significant markers in cell growth and organ development for 30 every significant marker of pregnancy until birth. 31 Sec. 2. Section 256.11, subsection 5, paragraph j, 32 subparagraph (1), Code 2024, is amended to read as follows: 33 (1) One unit of health education which may include personal 34 health; food and nutrition; environmental health; safety and 35 -2- LSB 5035YH (7) 90 jda/jh 2/ 4
H.F. 2031 survival skills; consumer health; family life; age-appropriate 1 and research-based human growth and development; substance 2 use disorder and nonuse; emotional and social health; health 3 resources; cardiopulmonary resuscitation; and prevention 4 and control of disease, including age-appropriate and 5 research-based information regarding sexually transmitted 6 diseases. The health education curriculum shall include all 7 of the following: 8 (a) Human biology related to pregnancy. 9 (b) Human development inside the womb. 10 (c) A high-definition ultrasound video, at least three 11 minutes in duration, showing the development of the brain, 12 heart, sex organs, and other vital organs in early fetal 13 development. 14 (d) A high-quality, computer-generated rendering or 15 animation, comparable to the meet baby Olivia video developed 16 by live action, showing the process of fertilization and 17 every stage of human development inside the uterus, noting 18 significant markers in cell growth and organ development for 19 every significant marker of pregnancy until birth. 20 Sec. 3. Section 256E.7, subsection 2, paragraph g, Code 21 2024, is amended to read as follows: 22 g. Be subject to and comply with the requirements of section 23 256.7, subsection 21 , and the educational standards of section 24 256.11 , unless specifically waived by the state board during 25 the application process ; provided, however, that the state 26 board shall not waive the educational standards of section 27 256.11 relating to the human growth and development curriculum 28 for grades one through eight or the health curriculum for 29 grades nine through twelve . 30 Sec. 4. Section 256F.4, subsection 2, Code 2024, is amended 31 by adding the following new paragraph: 32 NEW PARAGRAPH . p. Be subject to and comply with the 33 requirements of section 256.11 relating to the human growth and 34 development curriculum for grades one through eight and the 35 -3- LSB 5035YH (7) 90 jda/jh 3/ 4
H.F. 2031 health curriculum for grades nine through twelve. 1 EXPLANATION 2 The inclusion of this explanation does not constitute agreement with 3 the explanation’s substance by the members of the general assembly. 4 This bill incorporates provisions related to pregnancy and 5 fetal development into the human growth and development and 6 health curriculum provided by school districts, accredited 7 nonpublic schools, charter schools, and innovation zone schools 8 to students enrolled in grades 1 through 12. 9 The bill requires that the human growth and development 10 curriculum provided by school districts, nonpublic schools, 11 charter schools, and innovation zone schools in grades 1 12 through 8, and the health curriculum in grades 9 through 13 12, include instruction regarding human biology related to 14 pregnancy and human development inside the womb.
