H.F. 2021 Section 1. NEW SECTION . 2B.14 Iowa Code —— ten-year repeal 1 —— legislative review and reenactment. 2 1. The following titles of the Iowa Code are repealed as of 3 the following dates: 4 a. Titles I and II, July 1, 2025, and every ten years 5 thereafter. 6 b. Titles III and IV, July 1, 2026, and every ten years 7 thereafter. 8 c. Titles V and XI, July 1, 2027, and every ten years 9 thereafter. 10 d. Title VI, July 1, 2028, and every ten years thereafter. 11 e. Title VII, July 1, 2029, and every ten years thereafter. 12 f. Title VIII, July 1, 2030, and every ten years thereafter. 13 g. Title IX, July 1, 2031, and every ten years thereafter. 14 h. Title X, July 1, 2032, and every ten years thereafter. 15 i. Titles XII and XIII, July 1, 2033, and every ten years 16 thereafter. 17 j. Titles XIV, XV, and XVI, July 1, 2034, and every ten 18 years thereafter. 19 2. During the fiscal year prior to the repeal of a title of 20 the Iowa Code pursuant to subsection 1, the general assembly 21 shall, pursuant to procedures established by the legislative 22 council, review the title to determine any amendments that may 23 be necessary or appropriate. Such review may include a review 24 of any uncodified provisions enacted by the general assembly 25 that pertain to a title subject to such review. 26 3. The general assembly may, by enactment of one or more 27 Acts, reenact any title of the Iowa Code repealed or scheduled 28 to be repealed pursuant to subsection 1, in whole or in part, 29 with any amendments the general assembly may find necessary or 30 appropriate after review pursuant to subsection 2. 31 EXPLANATION 32 The inclusion of this explanation does not constitute agreement with 33 the explanation’s substance by the members of the general assembly. 34 This bill provides for the repeal of titles of the Code every 35 -1- LSB 5213YH (1) 90 sc/ns 1/ 2
H.F. 2021 10 years over a 10-year period beginning July 1, 2025. 1 The bill directs the general assembly, pursuant to 2 procedures established by the legislative council, to review a 3 title during the fiscal year prior to its repeal to determine 4 any amendments that may be necessary or appropriate. 5 The bill provides that the general assembly may, by 6 enactment of one or more Acts, reenact any title repealed or 7 scheduled to be repealed pursuant to the bill, in whole or 8 in part, with any amendments the general assembly may find 9 necessary or appropriate after such review. 10 The schedule for repeal of titles pursuant to the bill is as 11 follows: 12 Titles I (state sovereignty and management) and II 13 (elections and official duties), July 1, 2025, and every 10 14 years thereafter. 15 Titles III (public services and regulation) and IV (public 16 health), July 1, 2026, and every 10 years thereafter. 17 Titles V (agriculture) and XI (natural resources), July 1, 18 2027, and every 10 years thereafter. 19 Title VI (human services), July 1, 2028, and every 10 years 20 thereafter. 21 Title VII (education, history, and culture), July 1, 2029, 22 and every 10 years thereafter. 23 Title VIII (transportation), July 1, 2030, and every 10 24 years thereafter. 25 Title IX (local government), July 1, 2031, and every 10 years 26 thereafter. 27 Title X (financial resources), July 1, 2032, and every 10 28 years thereafter. 29 Titles XII (business entities) and XIII (commerce), July 1, 30 2033, and every 10 years thereafter. 31 Titles XIV (property), XV (judicial branch and judicial 32 procedures), and XVI (criminal law and procedure), July 1, 33 2034, and every 10 years thereafter. 34 -2- LSB 5213YH (1) 90 sc/ns 2/ 2
