H.F. 2020 Section 1. NEW SECTION . 8.37 Annual appropriations for 1 operations of state government. 2 1. If the general assembly adjourns a regular session 3 without the passage of any Act containing annual appropriations 4 for the operations of state government for the fiscal year 5 beginning July 1 of the calendar year in which the regular 6 session occurs, all of the following apply: 7 a. (1) For all line item appropriations, standing limited 8 appropriations, and standing unlimited appropriations otherwise 9 limited by law, including appropriations from federal and 10 nonstate funds, made for the prior fiscal year, the department 11 of management, in consultation with the legislative services 12 agency, shall determine the amount of the appropriations by 13 taking into consideration all of the following: 14 (a) All Iowa Acts appropriating moneys for the prior fiscal 15 year. 16 (b) All interdepartmental and intradepartmental transfers 17 made pursuant to section 8.39 and other provisions of law for 18 the prior fiscal year. 19 (c) Any other provisions of law affecting appropriations 20 for the prior fiscal year. 21 (2) The department of management, in consultation with the 22 legislative services agency, shall also identify the entities 23 to which such appropriations were made, or the entities’ 24 successors. 25 b. There is appropriated from the appropriate state fund or 26 account to the entities identified pursuant to paragraph “a” , 27 subparagraph (2), for the fiscal year beginning July 1 of the 28 calendar year in which the regular session occurs, amounts, or 29 so much thereof as is necessary, equal to the amounts of the 30 appropriations made for the prior fiscal year, as determined 31 pursuant to paragraph “a” , subparagraph (1), each reduced by 32 one-half of one percent. 33 2. Appropriations made pursuant to subsection 1 shall not 34 include any of the following from the prior fiscal year, as 35 -1- LSB 5219YH (2) 90 ns/jh 1/ 3
H.F. 2020 determined by the department of management, in consultation 1 with the legislative services agency: 2 a. Transfers of moneys. 3 b. Appropriations for capital or infrastructure projects 4 that do not require another appropriation. 5 c. Appropriations for pilot projects or other temporary 6 measures that do not require another appropriation. 7 3. If appropriations made from the general fund of the state 8 pursuant to subsection 1 would not comply with the general 9 fund expenditure limitation under section 8.54, the department 10 of management, in consultation with the legislative services 11 agency, shall further reduce appropriations made from the 12 general fund of the state pursuant to subsection 1, each by the 13 same percentage, such that appropriations made from the general 14 fund of the state pursuant to subsection 1 comply with the 15 general fund expenditure limitation under section 8.54. 16 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 17 importance, takes effect upon enactment. 18 Sec. 3. APPLICABILITY. This Act applies to fiscal years 19 beginning on or after July 1, 2024. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 If the general assembly adjourns a regular session without 24 the passage of any Act containing annual appropriations for 25 the operations of state government for the upcoming fiscal 26 year, this bill appropriates moneys for the operations of state 27 government for that fiscal year based on the appropriations for 28 the prior fiscal year, reduced by 0.5 percent. 29 In order to accurately make the appropriations under the 30 bill, the bill requires the department of management, in 31 consultation with the legislative services agency, to identify 32 for the prior fiscal year (1) the amounts appropriated, (2) 33 the entities that received the appropriations, and (3) any 34 appropriations, such as those for infrastructure projects or 35 -2- LSB 5219YH (2) 90 ns/jh 2/ 3
H.F. 2020 pilot projects, which would not require another appropriation. 1 If necessary, any general fund appropriations are further 2 reduced by an equal percentage in order to comply with the 3 state general fund expenditure limitation (Code section 8.54). 4 The bill takes effect upon enactment and applies to fiscal 5 years beginning on or after July 1, 2024. 6 -3- LSB 5219YH (2) 90 ns/jh 3/ 3
