H.F. 2013 Section 1. Section 155.9, Code 2024, is amended to read as 1 follows: 2 155.9 Duties of the board —— rules for provisional licenses. 3 In addition to the duties and responsibilities provided 4 in chapters 147 and 272C , the board shall adopt rules for 5 granting a provisional license to an administrator appointed 6 on a temporary basis by a nursing home’s owner or owners in the 7 event the regular administrator of the nursing home is unable 8 to perform the administrator’s duties or the nursing home is 9 without a licensed administrator because of death or other 10 cause. Such provisional license shall allow the provisional 11 licensee to perform the duties of a nursing home administrator. 12 An individual shall not hold a provisional license for more 13 than twelve twenty-four total combined months, and the board 14 may revoke or otherwise discipline a provisional licensee for 15 cause after due notice and a hearing on a charge or complaint 16 filed with the board. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill changes the amount of time that a person may hold 21 a provisional nursing home administrator license when the 22 regular administrator of the nursing home is unable to perform 23 the administrator’s duties from 12 total combined months to 24 24 total combined months. 25 -1- LSB 5226YH (2) 90 ss/ko 1/ 1
