H.F. 2005 Section 1. MEDICAID HOME AND COMMUNITY-BASED SERVICES 1 WAIVER SERVICES —— PARENTS AND LEGAL GUARDIANS OF MINORS 2 —— REIMBURSED PROVIDERS OF PERSONAL CARE SERVICES. The 3 department of health and human services shall submit a waiver 4 amendment request to the centers for Medicare and Medicaid 5 services of the United States department of health and human 6 services for approval to incorporate into the state’s home 7 and community-based services 1915(c) waivers, on an ongoing 8 basis, the flexibilities applicable under Appendix K during 9 the COVID-19 public health emergency that allow, to the 10 maximum extent authorized under federal law, parents and legal 11 guardians of minors to be paid providers for the purposes of 12 delivering personal care services under the consumer choices 13 option. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill requires the department of health and human 18 services to submit a waiver amendment request to the centers 19 for Medicare and Medicaid services of the United States 20 department of health and human services for approval to 21 incorporate into the state’s home and community-based services 22 1915(c) waivers, on an ongoing basis, the flexibilities 23 applicable under Appendix K during the COVID-19 public health 24 emergency that allow, to the maximum extent authorized under 25 federal law, parents and legal guardians of minors to be paid 26 providers for the purposes of delivering personal care services 27 under the consumer choices option. 28 -1- LSB 5082YH (6) 90 pf/ko 1/ 1
