Driftless
area
development

conservation
authority
——
membership
and
duties.

1.
A
driftless
area
development
and
conservation
authority
3
is
created.
The
counties
of
Allamakee,
Clayton,
Dubuque,
4
Delaware,
Fayette,
Jackson,
and
Winneshiek
are
entitled
to
5
one
voting
member
each
on
the
authority,
but
membership
or
6
participation
in
projects
of
the
authority
is
not
required.
7
Each
member
of
the
authority
shall
be
appointed
by
the
8
respective
board
of
supervisors
for
a
term
to
be
determined
by
9
each
board
of
supervisors,
but
the
term
shall
not
be
for
less
10
than
one
year.
An
appointee
shall
serve
without
compensation,
11
but
an
appointee
may
be
reimbursed
for
actual
expenses
incurred
12
while
performing
the
duties
of
the
authority
as
determined
by
13
each
board
of
supervisors.
The
authority
shall
meet,
organize,
14
and
adopt
rules
of
procedures
as
deemed
necessary
to
carry
out
15
its
duties.
The
authority
may
appoint
working
committees
that
16
include
other
individuals
in
addition
to
voting
members.

2.
The
mission
of
the
authority
is
to
develop
and
18
coordinate
plans
for
projects
related
to
the
unique
natural
19
resources,
rural
development,
and
infrastructure
problems
and
20
opportunities
in
the
driftless
region
of
northeast
Iowa.
21
3.
The
authority
shall
cooperate
with
the
department
of
22
natural
resources,
the
division
of
soil
conservation
and
water
23
quality
created
within
the
department
of
agriculture
and
land
24
stewardship
pursuant
to
section
159.5,
the
affected
soil
25
and
water
conservation
districts,
any
watershed
management
26
authorities
established
within
the
authority’s
jurisdiction,
27
the
Mississippi
river
parkway
commission,
and
the
state
28
department
of
transportation
in
carrying
out
the
authority’s
29
mission
and
duties.
The
authority
shall
also
cooperate
30
with
appropriate
federal
agencies,
including
the
United
31
States
environmental
protection
agency,
the
United
States
32
department
of
the
interior,
and
the
United
States
department
33
of
agriculture
natural
resources
conservation
service.
The
34
authority
shall
make
use
of
technical
resources
available

through
member
counties
and
cooperating
agencies.

The
authority
shall
administer
the
driftless
area

development
and
conservation
fund
created
under
section
3
161D.15
and
shall
deposit
and
expend
moneys
in
the
fund
for
the
4
planning,
development,
and
implementation
of
development
and
5
conservation
activities
or
measures
in
the
member
counties.

5.
This
section
is
not
intended
to
affect
the
authority
7
of
the
department
of
natural
resources
in
its
acquisition,
8
development,
and
management
of
public
lands
within
the
counties
9
represented
by
the
authority.

6.
In
matters
relating
to
the
conservation,
preservation,
11
or
development
of
the
driftless
area,
state
agencies
shall
12
coordinate,
cooperate,
and
consult
with
the
driftless
area
13
development
and
conservation
authority
and
its
associated
14
alliances.

Sec.
2.
NEW
SECTION
.
161D.15
Driftless
area
development
and
16
conservation
fund.
17
A
driftless
area
development
and
conservation
fund
is
18
created
in
the
state
treasury,
to
be
administered
by
the
19
driftless
area
development
and
conservation
authority.
The
20
moneys
in
the
fund
are
appropriated
to
the
authority
for
the
21
purposes
specified
in
section
161D.14
as
applicable.
The
22
driftless
area
development
and
conservation
authority
may
23
accept
gifts,
bequests,
other
moneys
including
but
not
limited
24
to
state
or
federal
moneys,
and
in-kind
contributions
for
25
deposit
in
the
fund.
The
gifts,
grants,
bequests
from
public
26
and
private
sources,
state
and
federal
moneys,
and
other
moneys
27
received
by
the
authority
shall
be
deposited
in
the
fund
and
28
notwithstanding
section
12C.7,
subsection
2,
any
interest
29
earned
on
moneys
in
the
fund
shall
be
credited
to
the
fund
30
to
be
used
for
the
purposes
specified
in
section
161D.14.
31
Notwithstanding
section
8.33,
any
unencumbered
or
unobligated
32
moneys
remaining
in
the
fund
at
the
end
of
the
fiscal
year
33
shall
not
revert
but
shall
remain
available
for
expenditure
by
34
the
authority
in
succeeding
fiscal
years.

1
The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
creates
a
driftless
area
development
and
4
conservation
authority
and
the
driftless
area
development
5
and
conservation
fund.
The
authority
shall
be
made
up
of
no
6
more
than
one
voting
member
from
each
county
of
Allamakee,
7
Clayton,
Dubuque,
Delaware,
Fayette,
Jackson,
and
Winneshiek,
8
but
membership
or
participation
in
authority
projects
is
not
9
required.
10
The
mission
of
the
authority
is
to
develop
and
coordinate
11
plans
for
projects
related
to
problems
and
opportunities
in
12
the
driftless
region
of
northeast
Iowa.
The
authority
shall
13
cooperate
with
state
and
federal
agencies
and
utilize
the

from

and

authority

bill

authority

State

authority

for
certain

matters
relating
to
the
driftless
area.
