H.F. 162 Section 1. NEW SECTION . 455C.19 Refund value excess —— 1 alcoholic beverages division —— shelter assistance fund. 2 1. For purposes of this section: 3 a. “Division” means the alcoholic beverages division of the 4 department of commerce. 5 b. “Return receipt” means a receipt indicating the number of 6 empty beverage containers for which the division paid refund 7 value to a participating dealer, dealer agent, or redemption 8 center. 9 c. “Sales receipt” means a receipt indicating the number of 10 beverage containers sold by the division to a dealer. 11 2. On a monthly basis, the division shall submit to the 12 treasurer of state any refund value excess possessed by the 13 division. The refund value excess shall be determined by 14 subtracting the amount of refund value and any handling fees 15 paid in the return receipts from the refund value received in 16 the sales receipts. Of the moneys received from the division, 17 the treasurer of state shall deposit fifty percent in the 18 shelter assistance fund established in section 16.41 and fifty 19 percent in the general fund of the state. 20 Sec. 2. INITIAL SUBMISSION. The first monthly submission 21 required under section 455C.19, as enacted in this Act, 22 covering July 2023, is due August 15, 2023. 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 This bill relates to excess refund value possessed by the 27 alcoholic beverages division (ABD). Under current law, with 28 some exceptions, ABD has the exclusive right of importation 29 into the state of all forms of alcoholic liquor. A class “E” 30 retail alcohol licensee may purchase alcoholic liquor from 31 ABD at wholesale only. When ABD sells alcoholic liquor to a 32 dealer, ABD adds 5 cents per eligible container to the sale 33 price. When a dealer sells beverages in eligible containers 34 to a consumer, the dealer adds the 5-cent deposit to the 35 -1- LSB 1573YH (8) 90 js/ns 1/ 2

A consumer can take eligible 1 containers to a participating dealer or redemption center and 2 receive a 5-cent refund for every eligible container that 3 the consumer returns. ABD contracts for the collection of 4 containers from participating dealers, dealer agents, and 5 redemption centers. 6 The bill requires ABD to submit monthly any refund value 7 excess to the treasurer of state, of which 50 percent is 8 deposited in the shelter assistance fund and 50 percent is 9 deposited in the general fund. The shelter assistance fund is 10 used by the Iowa finance authority to issue grants for services 11 for persons who are homeless or victims of domestic violence. 12 The first submission under the bill, covering July 2023, is 13 due August 15, 2023. 14 -2- LSB 1573YH (8) 90 js/ns 2/ 2
