H.F. 103 Section 1. NEW SECTION . 455B.103B Natural resource use 1 permits. 2 The director may issue up to ten natural resource use permits 3 each year that authorize economic development projects to use 4 or encroach on property managed or owned by the department. An 5 economic development project must promote the natural resources 6 of the state. The extent of the economic development project’s 7 use or encroachment shall not exceed one hundred square feet. 8 A permit issued under this section is valid for six months and 9 cannot be extended. The economic development project shall 10 not damage the property managed or owned by the department and 11 evidence of the use or encroachment shall not be visible on the 12 property after one year from the expiration of the permit. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill relates to the issuance of a natural resource 17 use permit (permit). The bill authorizes the director of 18 the department of natural resources (DNR) to issue up to 10 19 permits each year that authorize economic development projects 20 (project) to use or encroach on property managed or owned by 21 DNR. A project must promote the natural resources of the 22 state. A project’s use or encroachment shall not exceed 100 23 square feet of the property managed or owned by DNR. A permit 24 is valid for six months and cannot be extended. A project 25 shall not damage the property and evidence of the use or 26 encroachment shall not be visible on the property after one 27 year from the expiration of the permit. 28 By operation of law, a person who violates a permit issued 29 under the bill is subject to civil enforcement procedures, 30 including penalties, adopted by the environmental protection 31 commission. 32 -1- LSB 1595YH (2) 90 js/rn 1/ 1
