S.F. _____ H.F. _____ DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 9 a. (1) For deposit in the water quality initiative fund 10 created in section 466B.45 for purposes of supporting the 11 water quality initiative administered by the division of soil 12 conservation and water quality as provided in section 466B.42 , 13 including salaries, support, maintenance, and miscellaneous 14 purposes, notwithstanding section 8.57, subsection 5 , paragraph 15 “c”: 16 FY 2022-2023: 17 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,200,000 18 (2) (a) The moneys appropriated in this lettered 19 paragraph shall be used to support demonstration projects in 20 subwatersheds as designated by the department that are part 21 of high-priority watersheds identified by the water resources 22 coordinating council. 23 (b) The moneys appropriated in this lettered paragraph 24 shall be used to support demonstration projects in watersheds 25 generally, including regional watersheds, as designated by the 26 division and high-priority watersheds identified by the water 27 resources coordinating council. 28 (3) In supporting projects in watersheds and subwatersheds 29 as provided in subparagraph (2), all of the following shall 30 apply: 31 (a) The demonstration projects shall utilize water quality 32 practices as described in the latest revision of the document 33 entitled “Iowa Nutrient Reduction Strategy” initially presented 34 in November 2012 by the department of agriculture and land 35 -1- LSB 5017XG (6) 89 ec/tm 1/ 16
S.F. _____ H.F. _____ stewardship, the department of natural resources, and Iowa 1 state university of science and technology. 2 (b) The division shall implement demonstration projects 3 as provided in subparagraph division (a) by providing 4 for participation by persons who hold a legal interest in 5 agricultural land used in farming. To every extent practical, 6 the division shall provide for collaborative participation by 7 such persons who hold a legal interest in agricultural land 8 located within the same subwatershed. 9 (c) The division shall implement demonstration projects on 10 a cost-share basis as determined by the division. Except for 11 edge-of-field practices, the state’s share of the amount shall 12 not exceed 50 percent of the estimated cost of establishing the 13 practice as determined by the division or 50 percent of the 14 actual cost of establishing the practice, whichever is less. 15 (d) The demonstration projects shall be used to educate 16 other persons about the feasibility and value of establishing 17 similar water quality practices. The division shall promote 18 field day events for purposes of allowing interested persons to 19 establish water quality practices on their agricultural land. 20 (e) The division shall conduct water quality evaluations 21 within supported subwatersheds. Within a reasonable period 22 after accumulating information from such evaluations, the 23 division shall create an aggregated database of water quality 24 practices. Any information identifying a person holding a 25 legal interest in agricultural land or specific agricultural 26 land shall be a confidential record. 27 (4) The moneys appropriated in this lettered paragraph 28 shall be used to support education and outreach in a manner 29 that encourages persons who hold a legal interest in 30 agricultural land used for farming to implement water quality 31 practices, including the establishment of such practices in 32 watersheds generally, and not limited to subwatersheds or 33 high-priority watersheds. 34 (5) The moneys appropriated in this lettered paragraph 35 -2- LSB 5017XG (6) 89 ec/tm 2/ 16
S.F. _____ H.F. _____ may be used to contract with persons to coordinate the 1 implementation of efforts provided in this paragraph. 2 (6) The moneys appropriated in this lettered paragraph 3 may be used by the department to support urban soil and water 4 conservation efforts, which may include but are not limited 5 to management practices related to bioretention, landscaping, 6 the use of permeable or pervious pavement, and soil quality 7 restoration. The moneys shall be allocated on a cost-share 8 basis as provided in chapter 161A . 9 (7) Notwithstanding any other provision of law to the 10 contrary, the department may use moneys appropriated in 11 this lettered paragraph to carry out the provisions of this 12 paragraph on a cost-share basis in combination with other 13 moneys available to the department from a state or federal 14 source. 15 (8) Not more than 10 percent of the moneys appropriated in 16 this lettered paragraph may be used for costs of administration 17 and implementation of the water quality initiative administered 18 by the soil conservation division. 19 b. REVERSION. 21 1. For Except as provided in subsection 2, for purposes 22 of section 8.33 , unless specifically provided otherwise, 23 unencumbered or unobligated moneys from an appropriation made 24 in this division of this Act shall not revert but shall remain 25 available for expenditure for the purposes designated until the 26 close of the fiscal year that ends two years after the end of 27 the fiscal year for which the appropriation is made. For purposes of section 8.33, unless specifically 18 provided otherwise, unencumbered or unobligated moneys from an 19 appropriation made in section 3, subsection 6, of this division 20 of this 2019 Act shall not revert but shall remain available 21 for expenditure for the purposes designated until the close of 22 the fiscal year that begins July 1, 2023, or until the project 23 for which the appropriation was made is completed, whichever 24 is earlier. 25 Sec. 8. EFFECTIVE DATE. This division of this Act, being 26 deemed of immediate importance, takes effect upon enactment. 27 DIVISION IV 28 MISCELLANEOUS PROVISIONS 29 Sec. 9. Section 8.57C, subsection 3, paragraph a, 30 subparagraph (3), Code 2022, is amended to read as follows: 31 (3) For the fiscal year beginning July 1, 2022 2023 , and for 32 each subsequent fiscal year thereafter, the sum of seventeen 33 million five hundred thousand dollars. 34 Sec. 10. Section 8.57C, subsection 3, Code 2022, is amended 35 -13- LSB 5017XG (6) 89 ec/tm 13/ 16
S.F. _____ H.F. _____ by adding the following new paragraph: 1 NEW PARAGRAPH . j. There is appropriated from the rebuild 2 Iowa infrastructure fund for the fiscal year beginning July 1, 3 2022, and ending June 30, 2023, the sum of twenty million five 4 hundred thousand dollars to the technology reinvestment fund, 5 notwithstanding section 8.57, subsection 5, paragraph “c” . 6 Sec. 11. NEW SECTION . 15.221 Carbon ignition fund. 7 1. A carbon ignition fund is created in the state treasury 8 under the control of the authority. The fund shall consist of 9 all moneys appropriated to the fund. 10 2. Moneys in the carbon ignition fund are appropriated to 11 the authority for purposes of funding grants for projects in 12 agriculture and energy for increased participation in carbon 13 markets. 14 3. Notwithstanding section 12C.7, subsection 2, interest 15 or earnings on moneys deposited in the carbon ignition fund 16 shall be credited to the carbon ignition fund. Notwithstanding 17 section 8.33, moneys credited to the carbon ignition fund shall 18 not revert at the close of a fiscal year. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill relates to and makes appropriations to state 23 departments and agencies from the rebuild Iowa infrastructure 24 fund and the technology reinvestment fund, and provides for 25 related matters. The bill is organized by divisions. 26 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 27 division appropriates project funding for FY 2022-2023 from 28 the rebuild Iowa infrastructure fund for projects for the 29 departments of agriculture and land stewardship, the blind, 30 corrections, cultural affairs, human services, natural 31 resources, public defense, public safety, and transportation, 32 and for the economic development authority, treasurer of state, 33 and the judicial branch. The division also appropriates 34 project funding from the rebuild Iowa infrastructure fund for 35 -14- LSB 5017XG (6) 89 ec/tm 14/ 16
S.F. _____ H.F. _____ multiple fiscal years to the board of regents and the state 1 fair authority. 2 DIVISION II —— TECHNOLOGY REINVESTMENT FUND. This 3 division appropriates project funding for FY 2022-2023 4 from the technology reinvestment fund for the departments 5 of corrections, education, homeland security and emergency 6 management, human rights, inspections and appeals, management, 7 public defense, public safety, and revenue, and for the Iowa 8 telecommunications and technology commission, and the judicial 9 branch. 10 DIVISION III —— CHANGES TO PRIOR APPROPRIATIONS. This 11 division allows moneys appropriated from the technology 12 reinvestment fund to the department of human services over 13 multiple fiscal years beginning with FY 2018-2019 that would 14 revert if unencumbered and unexpended three years after the 15 close of the fiscal year in which the appropriation was made 16 to not revert until four years after the close of the fiscal 17 year in which the appropriation was made. The division also 18 allows moneys appropriated to the Iowa veterans home for FY 19 2019-2020 that would revert if unencumbered and unexpended 20 as of June 30, 2022, to not revert but remain available for 21 expenditure until the close of the fiscal year beginning July 22 1, 2022. The division also allows moneys appropriated to the 23 department of human services for FY 2019-2020 that would revert 24 if unencumbered and unexpended as of June 30, 2022, to not 25 revert but remain available for expenditure until the close of 26 the fiscal year beginning July 1, 2023. This division of the 27 bill takes effect upon enactment. 28 DIVISION IV —— MISCELLANEOUS PROVISIONS. Code section 29 8.57C, concerning the technology reinvestment fund, is amended 30 to provide that the standing appropriation to the fund from the 31 general fund for fiscal years beginning on or after July 1, 32 2022, is changed to fiscal years beginning on or after July 1, 33 2023, and to provide for an appropriation to the fund from the 34 rebuild Iowa infrastructure fund for the fiscal year beginning 35 -15- LSB 5017XG (6) 89 ec/tm 15/ 16
