S.F. _____ Section 1. Section 321.285, subsection 5, paragraph a, Code 1 2022, is amended to read as follows: 2 a. Notwithstanding any other speed restrictions, the speed 3 limit for all vehicular traffic on fully controlled-access, 4 divided, multilaned highways is sixty-five miles per hour. 5 However, the speed limit for all vehicular traffic on highways 6 that are part of the interstate road system , as defined in 7 section 306.3 , is seventy seventy-five miles per hour , and the 8 speed limit for all vehicular traffic on noninterstate fully 9 controlled-access, divided, multilaned highways identified 10 by the commission as part of the network of commercial and 11 industrial highways is seventy miles per hour . The department 12 may establish a speed limit of sixty-five miles per hour on 13 certain divided, multilaned highways not otherwise described 14 in this paragraph. 15 Sec. 2. Section 805.8A, subsection 14, paragraph i, 16 subparagraphs (1), (2), (3), and (4), Code 2022, are amended 17 to read as follows: 18 (1) One Three hundred ninety-five ninety dollars for speed 19 not more than ten miles per hour over the posted speed limit. 20 (2) Three Seven hundred ninety eighty dollars for speed 21 greater than ten but not more than twenty miles per hour over 22 the posted speed limit. 23 (3) Six One thousand two hundred forty-five ninety dollars 24 for speed greater than twenty but not more than twenty-five 25 miles per hour over the posted speed limit. 26 (4) One Two thousand two five hundred eighty-five seventy 27 dollars for speed greater than twenty-five miles per hour over 28 the posted speed limit. 29 EXPLANATION 30 The inclusion of this explanation does not constitute agreement with 31 the explanation’s substance by the members of the general assembly. 32 Current law provides that the speed limit for all vehicular 33 traffic is 55 miles per hour (mph) unless otherwise provided 34 for by other speed restrictions. S.F. _____ controlled-access, divided, multilaned highways is 65 mph. 1 The speed limit on highways that are part of the interstate 2 road system is 70 mph. The department of transportation (DOT) 3 is allowed to establish a speed limit of 65 mph on certain 4 divided, multilaned highways not already covered by Code 5 section 321.285(5)(a). 6 This bill increases the speed limit on highways that are part 7 of the interstate road system to 75 mph and on noninterstate 8 highways that are part of the commercial and industrial highway 9 network to 70 mph. 10 A violation of a speed restriction is punishable by a 11 scheduled fine with the amount of the fine determined by the 12 speed in excess of the limit under Code section 805.8A(5) 13 (speed violations), 805.8A(10) (school bus violations), or 14 805.8A(14)(i) (road work zone violations). However, a school 15 bus violation of more than 10 mph in excess of the limit 16 is not a scheduled violation and is punishable as a simple 17 misdemeanor. A simple misdemeanor is punishable by confinement 18 for no more than 30 days or a fine of at least $105 but not more 19 than $855 or by both. 20 The bill doubles the applicable fines for violating a speed 21 limit in a road work zone. 22 -2- LSB 5436XC (2) 89 th/ns 2/ 2
