S.F. _____ Section 1. NEW SECTION . 321.361A Parking meter fees 1 prohibited —— snow blocking meter. 2 1. Notwithstanding section 321.236, subsection 1, section 3 321.239, or any other provision of law to the contrary, the 4 state or a local authority shall not charge a fee at a parking 5 meter unless there is a path that is clear of snow directly 6 from the metered parking space to the adjacent sidewalk, and 7 the area around the parking meter is clear of snow, so as to 8 allow a person who parks a vehicle in the metered parking space 9 unimpeded access to the appropriate parking meter. 10 2. A citation for a parking violation issued in violation of 11 this section is void and unenforceable. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 Under current law, local authorities are specifically 16 authorized to regulate the standing or parking of vehicles 17 within their jurisdictions. 18 This bill prohibits the state or a local authority from 19 charging a fee at a parking meter unless there is a path that is 20 clear of snow directly from the metered parking space to the 21 adjacent sidewalk, and the area around the parking meter is 22 clear of snow, so as to allow a person who parks a vehicle in 23 the metered parking space unimpeded access to the appropriate 24 parking meter. 25 A citation for a parking violation issued in violation of the 26 bill is void and unenforceable. 27 -1- LSB 5944XC (2) 89 th/ns 1/ 1
