(a)
A
new
institutional
health

service
or
changed
institutional
health
service
which
will

be
developed
or
offered
within
a
county
in
which
a
hospital
5
requires
immunization
against
COVID-19
by
the
hospital’s
6
employees
as
a
condition
of
employment.

(b)
A
new
institutional
health
service
or
changed
8
institutional
health
service
which
will
be
developed
or
9
offered
in
or
through
an
institutional
health
facility,
health
10
maintenance
organization,
health
care
provider,
or
group
of
11
health
care
providers
that
does
not
require
immunization
12
against
COVID-19
by
its
employees
as
a
condition
of
employment.

(2)
For
the
purposes
of
this
paragraph:
14
(a)
“COVID-19”
means
the
disease
caused
by
the
novel
15
coronavirus
SARS-CoV-2
or
a
virus
mutating
therefrom,
and
16
conditions
associated
with
the
disease
caused
by
the
novel
17
coronavirus
SARS-CoV-2
or
a
virus
mutating
therefrom.

(b)
“Employee”
means
any
person
who
is
employed
for
19
wages
by
or
who
works
under
contract
for
an
institutional
20
health
facility,
health
maintenance
organization,
health
care
21
provider,
or
group
of
health
care
providers.

of
this
explanation
does
not
constitute
agreement

the

the
members

the
general

This
bill
excludes
from
required
application
for
and
receipt

of
a
certificate
of
need
a
new
institutional
health
service

or
changed
institutional
health
service
that
either
will
be
28
developed
or
offered
within
a
county
in
which
a
hospital
29
requires
immunization
against
COVID-19
by
the
hospital’s
30
employees
as
a
condition
of
employment,
or
will
be
developed
31
or
offered
in
or
through
an
institutional
health
facility,
32
health
maintenance
organization,
health
care
provider,
or
group
33
of
health
care
providers
that
does
not
require
immunization
34
against
COVID-19
by
its
employees
as
a
condition
of
employment.
