S.F. _____ Section 1. Section 256.84, Code 2022, is amended by adding 1 the following new subsections: 2 NEW SUBSECTION . 12. All of the board’s records, videos, 3 electronic storage, documents, tape, and other information, 4 stored or preserved in any medium, are public records pursuant 5 to chapter 22 and are subject to the rights of examination, 6 copying, and dissemination as provided in section 22.2, unless 7 the record, video, electronic storage, document, tape, or other 8 information is confidential under section 22.7. 9 NEW SUBSECTION . 13. The board, administrator, department, 10 or any other person on behalf of the state shall not enforce 11 any copyright, trademark, or any other intellectual property 12 right associated with a public record identified in subsection 13 12 more than ten years after the public record was originally 14 created, produced, filmed, or developed. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill relates to the records of the Iowa public 19 broadcasting board. 20 The bill provides that all of the Iowa public broadcasting 21 board’s records, videos, electronic storage, documents, tape, 22 and other information are public records pursuant to Code 23 chapter 22 and are subject to the right of examination unless 24 the record, video, electronic storage, document, tape, or other 25 information is confidential under Code section 22.7. 26 The bill prohibits the board, the administrator of the 27 public broadcasting division of the department of education, 28 the department, and any other person on behalf of the state 29 from enforcing any intellectual property right associated with 30 the board’s public records more than 10 years after the public 31 record was originally created. 32 -1- LSB 5191XC (1) 89 jda/jh 1/ 1
