NEW SECTION . 622.31A Deposition of victims of 1 sexual abuse. 2 The provisions of rule of evidence 5.412 shall apply to 3 all discovery conducted in a criminal case or postconviction 4 proceeding involving sexual abuse including but not limited 5 to depositions. The procedure to determine the admissibility 6 of evidence at trial concerning the past sexual behavior of 7 an alleged victim of sexual abuse involving notice, offers of 8 proof, and in camera reviews shall apply to depositions and 9 other discovery in such cases. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill relates to the discovery of evidence in criminal 14 cases involving victims of sexual abuse. 15 The bill provides that the provisions of rule of evidence 16 5.412 (sexual abuse cases; victim’s past sexual behavior) 17 shall apply to all discovery conducted in a criminal case 18 or postconviction proceeding including but not limited to 19 depositions.
