S.F. _____ DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 14 a. (1) For deposit in the water quality initiative fund 15 created in section 466B.45 for purposes of supporting the 16 water quality initiative administered by the division of soil 17 conservation and water quality as provided in section 466B.42 , 18 including salaries, support, maintenance, and miscellaneous 19 purposes, notwithstanding section 8.57, subsection 5 , paragraph 20 “c”: 21 FY 2021-2022: 22 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,200,000 23 (2) (a) The moneys appropriated in this lettered 24 paragraph shall be used to support demonstration projects in 25 subwatersheds as designated by the department that are part 26 of high-priority watersheds identified by the water resources 27 coordinating council. 28 (b) The moneys appropriated in this lettered paragraph 29 shall be used to support demonstration projects in watersheds 30 generally, including regional watersheds, as designated by the 31 division and high-priority watersheds identified by the water 32 resources coordinating council. 33 (3) In supporting projects in watersheds and subwatersheds 34 as provided in subparagraph (2), all of the following shall 35 -1- LSB 1008XC (7) 89 ec/tm 1/ 20
S.F. _____ apply: 1 (a) The demonstration projects shall utilize water quality 2 practices as described in the latest revision of the document 3 entitled “Iowa Nutrient Reduction Strategy” initially presented 4 in November 2012 by the department of agriculture and land 5 stewardship, the department of natural resources, and Iowa 6 state university of science and technology. 7 (b) The division shall implement demonstration projects 8 as provided in subparagraph division (a) by providing 9 for participation by persons who hold a legal interest in 10 agricultural land used in farming. To every extent practical, 11 the division shall provide for collaborative participation by 12 such persons who hold a legal interest in agricultural land 13 located within the same subwatershed. 14 (c) The division shall implement demonstration projects on 15 a cost-share basis as determined by the division. Except for 16 edge-of-field practices, the state’s share of the amount shall 17 not exceed 50 percent of the estimated cost of establishing the 18 practice as determined by the division or 50 percent of the 19 actual cost of establishing the practice, whichever is less. 20 (d) The demonstration projects shall be used to educate 21 other persons about the feasibility and value of establishing 22 similar water quality practices. The division shall promote 23 field day events for purposes of allowing interested persons to 24 establish water quality practices on their agricultural land. 25 (e) The division shall conduct water quality evaluations 26 within supported subwatersheds. Within a reasonable period 27 after accumulating information from such evaluations, the 28 division shall create an aggregated database of water quality 29 practices. Any information identifying a person holding a 30 legal interest in agricultural land or specific agricultural 31 land shall be a confidential record. 32 (4) The moneys appropriated in this lettered paragraph 33 shall be used to support education and outreach in a manner 34 that encourages persons who hold a legal interest in 35 -2- LSB 1008XC (7) 89 ec/tm 2/ 20
S.F. _____ agricultural land used for farming to implement water quality 1 practices, including the establishment of such practices in 2 watersheds generally, and not limited to subwatersheds or 3 high-priority watersheds. 4 (5) The moneys appropriated in this lettered paragraph 5 may be used to contract with persons to coordinate the 6 implementation of efforts provided in this paragraph. 7 (6) The moneys appropriated in this lettered paragraph 8 may be used by the department to support urban soil and water 9 conservation efforts, which may include but are not limited 10 to management practices related to bioretention, landscaping, 11 the use of permeable or pervious pavement, and soil quality 12 restoration. The moneys shall be allocated on a cost-share 13 basis as provided in chapter 161A . 14 (7) Notwithstanding any other provision of law to the 15 contrary, the department may use moneys appropriated in 16 this lettered paragraph to carry out the provisions of this 17 paragraph on a cost-share basis in combination with other 18 moneys available to the department from a state or federal 19 source. 20 (8) Not more than 10 percent of the moneys appropriated in 21 this lettered paragraph may be used for costs of administration 22 and implementation of the water quality initiative administered 23 by the soil conservation division. 24 b. Section 8.57C, subsection 3, Code 2021, is amended 26 by adding the following new paragraph: 27 NEW PARAGRAPH . j. There is appropriated from the rebuild 28 Iowa infrastructure fund for the fiscal year beginning July 1, 29 2021, and ending June 30, 2022, the sum of seventeen million 30 five hundred thousand dollars to the technology reinvestment 31 fund, notwithstanding section 8.57, subsection 5, paragraph 32 “c” . 33 Sec. 13. S.F. _____ 15.261 Vacant state buildings demolition fund. 1 1. A vacant state buildings demolition fund is created in 2 the state treasury under the control of the authority. The 3 fund shall consist of all moneys appropriated to the fund. 4 2. Moneys in the vacant state buildings demolition fund 5 are appropriated to the authority for purposes of funding a 6 grant program for the demolition of vacant buildings owned by 7 the state or by a county that has purchased real property from 8 the federal government which are no longer used for a state 9 or federal purpose. The authority shall give preference to 10 applicants that have not previously been awarded money from 11 this fund. 12 3. Notwithstanding section 12C.7, subsection 2 , interest 13 or earnings on moneys deposited in the vacant state buildings 14 demolition fund shall be credited to the vacant state buildings 15 demolition fund. Notwithstanding section 8.33 , moneys credited 16 to the vacant state buildings demolition fund shall not revert 17 at the close of a fiscal year. 18 Sec. 14. Section 15.262, Code 2021, is amended to read as 19 follows: 20 15.262 Vacant state buildings rehabilitation fund. 21 1. A vacant state buildings rehabilitation fund is created 22 in the state treasury under the control of the authority. The 23 fund shall consist of all moneys appropriated to the fund. 24 2. Moneys in the vacant state buildings rehabilitation fund 25 are appropriated to the authority for purposes of funding a 26 loan program for the rehabilitation or redevelopment of vacant 27 buildings owned by the state or by a county that has purchased 28 real property from the federal government which are no longer 29 used for a state or federal purpose. The authority shall give 30 preference to applicants that have not previously been awarded 31 money from this fund. 32 3. Notwithstanding section 8.33 , 1 moneys credited to the vacant state buildings rehabilitation 2 fund shall not revert at the close of a fiscal year. 3 Sec. 15. ROUTINE MAINTENANCE FUND. Notwithstanding the 4 standing appropriation in section 8A.330, there is appropriated 5 from the rebuild Iowa infrastructure fund to the department of 6 administrative services for deposit in the routine maintenance 7 fund established in section 8A.330 for the fiscal year 8 beginning July 1, 2021, the sum of one million dollars. 9 DIVISION V 10 AUTISM SUPPORT FUND 11 Sec. 16. AUTISM SUPPORT FUND —— APPROPRIATION. There is 12 appropriated from the autism support fund created in section 13 225D.2 to the rebuild Iowa infrastructure fund created in 14 section 8.57, for the fiscal year beginning July 1, 2021, and 15 ending June 30, 2022, the sum of seven hundred fifty thousand 16 dollars, notwithstanding any provision of section 225D.2 to the 17 contrary. 18 DIVISION VI 19 SPORTS TOURISM PROGRAM 20 Sec. 17. Section 15F.401, subsection 1, paragraph a, Code 21 2021, is amended to read as follows: 22 a. The authority shall establish, and, at the direction of 23 the board, shall administer a sports tourism program to provide 24 financial assistance for projects that promote sporting events 25 for organizations of accredited colleges and universities , 26 professional sporting events, and other sporting events in the 27 state. 28 Sec. 18. Section 15F.401, subsection 1, paragraph b, 29 subparagraph (3), Code 2021, is amended to read as follows: 30 (3) “Organization” means a corporation, conference, 31 association, or other organization which has as one of 32 its primary purposes the sponsoring or administration 33 of extracurricular intercollegiate athletic contests or 34 competitions , or professional sporting events . 35 -17- LSB 1008XC (7) 89 ec/tm 17/ 20
S.F. _____ Sec. 19. Section 15F.401, subsection 1, paragraph b, Code 1 2021, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (4) “Professional sporting events” means 3 any sporting events for which the competing athletes receive 4 payment for their participation in such sporting event. 5 Sec. 20. Section 15F.401, subsection 2, paragraph a, Code 6 2021, is amended to read as follows: 7 a. A city or county in the state or a public entity, 8 including a convention and visitors bureau or a district, 9 may apply to the authority for financial assistance for a 10 project that actively and directly promotes sporting events for 11 accredited colleges and universities , professional sporting 12 events, and other sporting events in the area served by the 13 city, county, or public entity. 14 Sec. 21. SPORTS TOURISM PROGRAM —— SPORTS WAGERING RECEIPTS 15 FUND. There is appropriated from the sports wagering receipts 16 fund created in section 8.57, subsection 6, to the economic 17 development authority for the fiscal year beginning July 1, 18 2021, and ending June 30, 2022, the following amount, or so 19 much thereof as is necessary, to be used for the purposes 20 designated: 21 For the sports tourism program created in section 15F.401: 22 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,500,000 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 This bill relates to and makes appropriations to state 27 departments and agencies from the rebuild Iowa infrastructure 28 fund and the technology reinvestment fund, and provides for 29 related matters. The bill is organized by divisions. 30 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 31 division appropriates project funding for FY 2021-2022 from 32 the rebuild Iowa infrastructure fund for projects for the 33 departments of administrative services, agriculture and land 34 stewardship, blind, cultural affairs, human services, public 35 -18- LSB 1008XC (7) 89 ec/tm 18/ 20
S.F. _____ safety, transportation, and veterans affairs, and for the 1 economic development authority, board of regents, and treasurer 2 of state. The division also appropriates project funding from 3 the rebuild Iowa infrastructure fund for multiple fiscal years 4 to the departments of corrections, public defense, and natural 5 resources. 6 DIVISION II —— TECHNOLOGY REINVESTMENT FUND. This 7 division appropriates project funding for FY 2021-2022 8 from the technology reinvestment fund for the departments 9 of corrections, education, homeland security and emergency 10 management, human rights, human services, inspections and 11 appeals, management, public defense, public safety, revenue, 12 and veterans affairs, and for the judicial branch, the office 13 of the chief information officer, and for the ethics and 14 campaign disclosure board. 15 DIVISION III —— CHANGES TO PRIOR APPROPRIATIONS. This 16 division makes a change to moneys appropriated from the rebuild 17 Iowa infrastructure fund to the department of administrative 18 services for major maintenance projects, the economic 19 development authority for the vacant state buildings demolition 20 and rehabilitation funds, the board of regents for projects 21 at the Iowa state university of science and technology, and 22 the judicial branch for furniture and equipment at certain 23 justice centers. The division also makes a change to the 24 reversion provision for moneys appropriated from the rebuild 25 Iowa infrastructure fund to the department of cultural affairs 26 for maintenance projects for the state historical building in 27 FY 2017-2018. The division takes effect upon enactment. 28 DIVISION IV —— MISCELLANEOUS PROVISIONS. Code section 29 8.57C, concerning the technology reinvestment fund, is amended 30 to provide for an appropriation to the fund from the rebuild 31 Iowa infrastructure fund for the fiscal year beginning July 1, 32 2021, of $17.5 million. 33 Code section 15.261, concerning the vacant state buildings 34 demolition fund, is amended to allow moneys in the fund to be 35 -19- LSB 1008XC (7) 89 ec/tm 19/ 20
S.F. _____ used for demolition of vacant buildings purchased by a county 1 from the federal government. The Code section is also amended 2 to give preference to applicants who have not previously been 3 awarded money from the fund. 4 Code section 15.262, concerning the vacant state buildings 5 rehabilitation fund, is amended to allow moneys in the fund 6 to be used for rehabilitation of vacant buildings purchased 7 by a county from the federal government. The Code section is 8 also amended to give preference to applicants who have not 9 previously been awarded money from the fund. 10 The bill reduces the standing appropriation from the rebuild 11 Iowa infrastructure fund to the routine maintenance fund 12 created in Code section 8A.330 for the fiscal year beginning 13 July 1, 2021, from $2 million to $1 million. 14 DIVISION V —— AUTISM SUPPORT FUND. This division 15 appropriates moneys from the autism support fund to the rebuild 16 Iowa infrastructure fund for FY 2021-2022. 17 DIVISION VI —— SPORTS TOURISM PROGRAM. Code section 18 15F.401, creating the sports tourism program, is amended to 19 provide that the program is authorized to provide financial 20 assistance for projects that promote professional sporting 21 events.
