S.F. _____ Section 1. Section 279.10, Code 2021, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4. a. Except as otherwise provided in 3 this subsection or in accordance with a proclamation of public 4 health disaster emergency issued by the governor pursuant to 5 section 29C.6, a school district or accredited nonpublic school 6 shall not offer online learning as defined in section 256.2 7 or continuous remote learning unless the school district or 8 accredited nonpublic school meets the requirements of section 9 256.7, subsection 32, or section 256.11, subsection 17, as 10 appropriate. 11 b. A school district or accredited nonpublic school may, 12 for up to five school days when inclement weather causes the 13 school district or accredited nonpublic school to temporarily 14 close school during the regular school calendar, deliver the 15 regular school day coursework using an online learning platform 16 that meets the requirements of section 256.7, subsection 32, or 17 section 256.11, subsection 17, as appropriate. 18 c. The limitation on the number of school days specified in 19 paragraph “b” does not apply to a school district that provides 20 educational instruction and course content primarily over the 21 internet in accordance with section 256.7, subsection 32, 22 paragraph “c” , Code 2016. 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 This bill relates to online learning and continuous remote 27 learning provided by school districts and accredited nonpublic 28 schools. 29 The bill prohibits a school district or accredited nonpublic 30 school from offering online learning or continuous remote 31 learning unless the school district or accredited nonpublic 32 school meets requirements of Code section 256.7(32) or section 33 256.11(17), as appropriate, or is offering the online learning 34 or continuous remote learning in accordance with a proclamation 35 -1- LSB 1973XC (3) 89 kh/jh 1/ 2
S.F. _____ of public health disaster emergency issued by the governor. 1 However, the bill allows a school district or accredited 2 nonpublic school to use an online learning platform that meets 3 the requirements of Code section 256.7(32) or 256.11(17), as 4 appropriate, to deliver the regular school day coursework for 5 up to five school days when inclement weather causes the school 6 district or accredited nonpublic school to temporarily close 7 school during the regular school calendar.
