1.
Section
85.51,
Code
2021,
is
amended
to
read
as
1
follows:

85.51
Alien
dependents
in
foreign
country.
3
In
case
a
deceased
employee
for
whose
injury
or
death
4
compensation
is
payable
leaves
surviving
an
alien
dependent
5
or
dependents
residing
outside
the
United
States,
the
consul
6
general,
consul,
vice
consul,
or
consular
agent
of
the
nation
7
of
which
the
said
dependent
or
dependents
are
citizens,
or
8
the
duly
appointed
representative
of
such
consular
official
9
resident
in
the
state
of
Iowa,
shall
be
regarded
as
the
10
exclusive
representative
of
such
dependent
or
dependents,
and
11
said
the
consular
officials
or
their
representatives
shall
12
have
the
same
rights
and
powers
in
all
matters
of
compensation
13
which
said
the
nonresident
aliens
would
have
if
resident
in
14
the
state
of
Iowa.
However,
compensation
shall
not
be
payable
15
to
a
dependent
who
is
designated
as
a
terrorist
by
a
federal
16
agency
pursuant
to
applicable
federal
law
or
who
is
subject
to
17
an
arrest
warrant
issued
by
a
federal
agency.

This
bill
prohibits
payment
of
workers’
compensation
22
benefits
to
a
surviving
alien
dependent
of
a
person
to
whom
23
such
benefits
were
payable,
if
the
dependent
is
not
a
resident
24
of
the
United
States
and
is
also
either
designated
as
a
25
terrorist
by
a
federal
agency
pursuant
to
applicable
federal
26
law
or
subject
to
an
arrest
warrant
issued
by
a
federal
agency.
