Section 321.1, subsection 8, unnumbered 1 paragraph 1, Code 2021, is amended to read as follows: 2 “Chauffeur” means a person who operates a motor vehicle, 3 including a school bus, in the transportation of persons for 4 wages, compensation, or hire , or a person who operates a truck 5 tractor, road tractor, or a motor truck which has a gross 6 vehicle weight rating exceeding sixteen thousand pounds . 7 Sec. 2. Section 321.1, subsection 8, paragraph b, Code 2021, 8 is amended by striking the paragraph and inserting in lieu 9 thereof the following: 10 b. A fire fighter is not a chauffeur when operating a fire 11 apparatus. 12 Sec. 3. Section 321.1, subsection 8, Code 2021, is amended 13 by adding the following new paragraph: 14 NEW PARAGRAPH . 0c. An ambulance or rescue squad attendant 15 is not a chauffeur when operating an ambulance or rescue squad 16 apparatus. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 Under current law, chauffeurs are subject to special 21 driver’s licensing requirements. A chauffeur is a person 22 who operates a motor vehicle, including a school bus, in the 23 transportation of persons for wages, compensation, or hire, or 24 a person who operates a truck tractor, road tractor, or a motor 25 truck which has a gross vehicle weight rating exceeding 16,000 26 pounds. There are 12 exceptions that specifically exempt 27 certain persons from being considered a chauffeur. 28 This bill eliminates from the definition of chauffeur 29 persons who operate a truck tractor, road tractor, or motor 30 truck which has a gross vehicle weight rating exceeding 16,000 31 pounds. The bill changes the existing exception relating to 32 volunteer fire fighters and volunteer ambulance and rescue 33 squad attendants by eliminating the volunteer requirement 34 and by eliminating the volunteer classification for persons 35 -1- LSB 1698XC (1) 89 th/ns 1/ 2

The bill exempts all fire fighters 2 when operating a fire apparatus and all ambulance and rescue 3 squad attendants when operating an ambulance or rescue squad 4 apparatus from being considered a chauffeur. 5 The fee for a chauffeur’s instruction permit is $12 compared 6 to a fee of $6 for an instruction permit other than a special 7 instruction, chauffeur’s instruction, or commercial learner’s 8 permit. The fee for a noncommercial chauffeur driver’s license 9 is $8 per year of validity compared to a fee of $4 per year of 10 validity for noncommercial driver’s licenses. 11 -2- LSB 1698XC (1) 89 th/ns 2/ 2
