S.F. _____ Section 1. Section 723.4, subsection 2, Code 2021, is 1 amended to read as follows: 2 2. Makes loud and raucous noise in the vicinity of any 3 residence or public building which intentionally or recklessly 4 causes unreasonable distress to the occupants thereof. 5 EXPLANATION 6 The inclusion of this explanation does not constitute agreement with 7 the explanation’s substance by the members of the general assembly. 8 Under current law, a person engages in disorderly conduct 9 when the person makes loud and raucous noise in the vicinity 10 of any residence or public building which causes unreasonable 11 distress to the occupants thereof. This bill requires a person 12 to intentionally or recklessly cause unreasonable distress when 13 the person engages in loud and raucous noise in the vicinity of 14 any residence or public building. 15 A person who violates this provision commits a simple 16 misdemeanor, punishable by confinement for no more than 30 days 17 or a fine of at least $105 but not more than $855 or both. 18 -1- LSB 1220XC (2) 89 as/rh 1/ 1
