S.F. 99 Section 1. Section 331.301, subsection 16, Code 2021, is 1 amended to read as follows: 2 16. a. The board of supervisors may by ordinance or 3 resolution prohibit or limit the use of consumer fireworks or 4 display fireworks, as described in section 727.2 , if the board 5 determines that the use of such devices would constitute a 6 threat to public safety or private property, or if the board 7 determines that the use of such devices would constitute a 8 nuisance to neighboring landowners. 9 b. The board of supervisors may by ordinance or resolution 10 prohibit or limit the sale of any variety of consumer 11 fireworks, as described in section 727.2, if the board 12 determines there is clear and convincing evidence that the sale 13 of such consumer fireworks would constitute a threat to public 14 safety or public health. 15 Sec. 2. Section 364.2, subsection 6, Code 2021, is amended 16 to read as follows: 17 6. a. A city council may by ordinance or resolution 18 prohibit or limit the use of consumer fireworks, display 19 fireworks, or novelties, as described in section 727.2 . 20 b. A city council may by ordinance or resolution prohibit 21 or limit the sale of any variety of consumer fireworks, as 22 described in section 727.2, if the city council determines 23 there is clear and convincing evidence that the sale of such 24 consumer fireworks would constitute a threat to public safety 25 or public health. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill relates to consumer fireworks.
