1.
NEW
SECTION
.
206.33A
Dicamba
—
prohibition.
1
1.
A
person
shall
not
offer
for
sale,
sell,
purchase,
apply,
2
or
use
the
chemical
compound
dicamba,
including
any
form
of
3
dicamba
which
is
an
ingredient
in
a
pesticide.

2.
The
department,
working
in
conjunction
with
the
5
department
of
natural
resources,
shall
identify
existing
stocks
6
of
dicamba,
shall
formulate
recommendations
for
the
safe
7
disposal
of
existing
stocks
of
dicamba,
and
shall
make
those
8
recommendations
available
to
the
owners
of
existing
stocks
of
9
dicamba.

2.
EFFECTIVE
DATE.
This
Act
takes
effect
January
1,
11
2022.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

GENERAL.
This
bill
amends
Code
chapter
206,
which
16
provides
for
the
regulation
of
pesticides
by
the
department
of
17
agriculture
and
land
stewardship
(DALS),
including
provisions
18
that
prohibit
certain
chemicals
such
as
chlordane
(Code
section
19
206.32)
and
daminozide
(Code
section
206.33)
which
are
utilized
20
as
pesticides.

PROHIBITION.
The
bill
prohibits
a
person
from
offering
22
for
sale,
selling,
purchasing,
applying,
or
using
the
23
chemical
compound
dicamba
which
is
the
active
ingredient
in
a
24
number
of
herbicides
used
to
manage
post-emergence
broadleaf
25
weeds
(annuals
and
perennials)
when
applied
to
a
number
of
26
agricultural
and
nonagricultural
sites.
DALS
is
required
to
27
cooperate
with
the
department
of
natural
resources
to
identify
28
existing
stocks
of
dicamba
and
recommend
methods
to
safely
29
dispose
of
the
chemical
compound.
30
PENALTY.
A
person
who
violates
a
provision
of
Code
31
chapter
206
is
guilty
of
a
serious
misdemeanor
(Code
section
32
206.22(2)).
A
serious
misdemeanor
is
punishable
by
confinement
33
for
no
more
than
one
year
and
a
fine
of
at
least
$430
but
not
34
more
than
$2,560.
