There is appropriated from the general fund of the state 5 to the department of justice for the fiscal year beginning July 6 1, 2021, and ending June 30, 2022, the following amounts, or 7 so much thereof as is necessary, to be used for the purposes 8 designated: 9 a. S.F. 599 The balance of the victim compensation fund established 1 in section 915.94 may be used to provide salary and support 2 of not more than 24.00 full-time equivalent positions and to 3 provide maintenance for the victim compensation functions 4 of the department of justice. In addition to the full-time 5 equivalent positions authorized pursuant to this paragraph, 6 7.00 full-time equivalent positions are authorized and shall 7 be used by the department of justice to employ one accountant 8 and four program planners. The department of justice may 9 employ the additional 7.00 full-time equivalent positions 10 authorized pursuant to this paragraph that are in excess of the 11 number of full-time equivalent positions authorized only if 12 the department of justice receives sufficient federal moneys 13 to maintain employment for the additional full-time equivalent 14 positions during the current fiscal year. The department 15 of justice shall only employ the additional 7.00 full-time 16 equivalent positions in succeeding fiscal years if sufficient 17 federal moneys are received during each of those succeeding 18 fiscal years. 19 The department of justice shall transfer at least $150,000 20 from the victim compensation fund established in section 915.94 21 to the victim assistance grant program established in section 22 13.31. 23 Notwithstanding section 8.33, moneys appropriated in this 24 lettered paragraph that remain unencumbered or unobligated at 25 the close of the fiscal year shall not revert but shall remain 26 available for expenditure for the purposes designated until the 27 close of the succeeding fiscal year. 28 c. The department of justice, in submitting budget 32 estimates for the fiscal year beginning July 1, 2022, pursuant 33 to section 8.23, shall include a report of funding from sources 34 other than amounts appropriated directly from the general fund 35 -2- LSB 1005SV (3) 89 as/tm 2/ 26
S.F. 599 of the state to the department of justice or to the office of 1 consumer advocate. These funding sources shall include but 2 are not limited to reimbursements from other state agencies, 3 commissions, boards, or similar entities, and reimbursements 4 from special funds or internal accounts within the department 5 of justice. The department of justice shall also report actual 6 reimbursements for the fiscal year beginning July 1, 2020, 7 and actual and expected reimbursements for the fiscal year 8 beginning July 1, 2021. 9 b. The department of justice shall include the report 10 required under paragraph “a”, as well as information regarding 11 any revisions occurring as a result of reimbursements actually 12 received or expected at a later date, in a report to the 13 general assembly. The department of justice shall submit the 14 report on or before January 15, 2022. 15 3. a. The department of justice shall fully reimburse 16 the costs and necessary related expenses incurred by the Iowa 17 law enforcement academy to continue to employ one additional 18 instructor position who shall provide training for human 19 trafficking-related issues throughout the state. 20 b. The department of justice shall obtain the moneys 21 necessary to reimburse the Iowa law enforcement academy to 22 employ such an instructor from unrestricted moneys from either 23 the victim compensation fund established in section 915.94, the 24 human trafficking victim fund established in section 915.95, or 25 the human trafficking enforcement fund established in 2015 Iowa 26 Acts, chapter 138, section 141. 27 Sec. 2. OFFICE OF CONSUMER ADVOCATE. It is the intent of the general assembly that each 5 lease negotiated by the department of corrections with a 6 private corporation for the purpose of providing private 7 industry employment of inmates in a correctional institution 8 shall prohibit the private corporation from utilizing inmate 9 labor for partisan political purposes for any person seeking 10 election to public office in this state and that a violation 11 of this requirement shall result in a termination of the lease 12 agreement. 13 b. It is the intent of the general assembly that as a 14 condition of receiving the appropriation provided in this 15 subsection the department of corrections shall not enter into 16 a lease or contractual agreement pursuant to section 904.809 17 with a private corporation for the use of building space for 18 the purpose of providing inmate employment without providing 19 that the terms of the lease or contract establish safeguards to 20 restrict, to the greatest extent feasible, access by inmates 21 working for the private corporation to personal identifying 22 information of citizens. 23 2. Each judicial district department of correctional 2 services, within the moneys available, shall continue programs 3 and plans established within that district to provide for 4 intensive supervision, sex offender treatment, diversion of 5 low-risk offenders to the least restrictive sanction available, 6 job development, and expanded use of intermediate criminal 7 sanctions. 8 4. Each judicial district department of correctional 9 services shall provide alternatives to prison consistent with 10 chapter 901B. The alternatives to prison shall ensure public 11 safety while providing maximum rehabilitation to the offender. 12 A judicial district department of correctional services may 13 also establish a day program. 14 5. The governor’s office of drug control policy shall 15 consider federal grants made to the department of corrections 16 for the benefit of each of the eight judicial district 17 departments of correctional services as local government 18 grants, as defined pursuant to federal regulations. 19 6. The department of corrections shall continue to contract 20 with a judicial district department of correctional services to 21 provide for the rental of electronic monitoring equipment which 22 shall be available statewide. 23 7. The public safety assessment shall not be utilized 24 in pretrial hearings when determining whether to detain or 25 release a defendant before trial, and the use of the public 26 safety assessment pilot program shall be terminated as of the 27 effective date of this subsection, until such time the use of 28 the public safety assessment has been specifically authorized 29 by the general assembly. 30 Sec. 6. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 31 APPROPRIATIONS. Notwithstanding section 8.39, within 32 the moneys appropriated in this Act to the department of 33 corrections, the department may reallocate the moneys 34 appropriated and allocated as necessary to best fulfill the 35 -9- LSB 1005SV (3) 89 as/tm 9/ 26
S.F. 599 needs of the correctional institutions, administration of 1 the department, and the judicial district departments of 2 correctional services. However, in addition to complying with 3 the requirements of sections 904.116 and 905.8 and providing 4 notice to the legislative services agency, the department 5 of corrections shall also provide notice to the department 6 of management, prior to the effective date of the revision 7 or reallocation of an appropriation made pursuant to this 8 section. The department of corrections shall not reallocate an 9 appropriation or allocation for the purpose of eliminating any 10 program. 11 Sec. 7. INTENT —— REPORTS. 12 1. The department of corrections, in cooperation with 13 townships, the Iowa cemetery associations, and other nonprofit 14 or governmental entities, may use inmate labor during the 15 fiscal year beginning July 1, 2021, to restore or preserve 16 rural cemeteries and historical landmarks. The department, in 17 cooperation with the counties, may also use inmate labor to 18 clean up roads, major water sources, and other water sources 19 around the state. 20 2. On a quarterly basis, the department shall provide 21 a status report regarding private-sector employment to the 22 general assembly beginning on July 1, 2021. The report shall 23 include the number of offenders employed in the private sector, 24 the combined number of hours worked by the offenders, the 25 total amount of allowances, and the distribution of allowances 26 pursuant to section 904.702, including any moneys deposited in 27 the general fund of the state. 28 Sec. 8. ELECTRONIC MONITORING REPORT. The department of 29 corrections shall submit a report on electronic monitoring 30 to the general assembly by January 15, 2022. The report 31 shall specifically address the number of persons being 32 electronically monitored and break down the number of persons 33 being electronically monitored by offense committed. The 34 report shall also include a comparison of any data from the 35 -10- LSB 1005SV (3) 89 as/tm 10/ 26
S.F. 599 prior fiscal year with the current fiscal year. 1 Sec. 9. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 2 1. As used in this section, unless the context otherwise 3 requires, “state agency” means the government of the state 4 of Iowa, including but not limited to all executive branch 5 departments, agencies, boards, bureaus, and commissions, the 6 judicial branch, the general assembly and all legislative 7 agencies, institutions within the purview of the state board of 8 regents, and any corporation whose primary function is to act 9 as an instrumentality of the state. 10 2. State agencies are encouraged to purchase products from 11 Iowa state industries, as defined in section 904.802, when 12 purchases are required and the products are available from 13 Iowa state industries. State agencies shall obtain bids from 14 Iowa state industries for purchases of office furniture during 15 the fiscal year beginning July 1, 2021, exceeding $5,000 or 16 in accordance with applicable administrative rules related to 17 purchases for the agency. 18 Sec. 10. IOWA LAW ENFORCEMENT ACADEMY. 19 1. There is appropriated from the general fund of the 20 state to the Iowa law enforcement academy for the fiscal year 21 beginning July 1, 2021, and ending June 30, 2022, the following 22 amount, or so much thereof as is necessary, to be used for the 23 purposes designated: 24 a. The Iowa law enforcement academy may select at least 2 five automobiles of the department of public safety, division 3 of state patrol, prior to turning over the automobiles to 4 the department of administrative services to be disposed 5 of by public auction, and the Iowa law enforcement academy 6 may exchange any automobile owned by the academy for each 7 automobile selected if the selected automobile is used in 8 training law enforcement officers at the academy. However, any 9 automobile exchanged by the academy shall be substituted for 10 the selected vehicle of the department of public safety and 11 sold by public auction with the receipts being deposited in the 12 depreciation fund maintained pursuant to section 8A.365 to the 13 credit of the department of public safety, division of state 14 patrol. 15 3. The Iowa law enforcement academy shall provide training 16 for domestic abuse and human trafficking-related issues 17 throughout the state. The training shall be offered at no 18 cost to the attendees and the training shall not replace any 19 existing domestic abuse or human trafficking training offered 20 by the academy. 21 Sec. 11. STATE PUBLIC DEFENDER. There is appropriated from 22 the general fund of the state to the office of the state public 23 defender of the department of inspections and appeals for the 24 fiscal year beginning July 1, 2021, and ending June 30, 2022, 25 the following amounts, or so much thereof as is necessary, to 26 be used for the purposes designated: 27 1. Section 85.67, Code 2021, is amended to read as 25 follows: 26 85.67 Administration of fund —— special counsel —— payment of 27 award. 28 The attorney general shall appoint a staff member 29 to represent the treasurer of state and the fund in all 30 proceedings and matters arising under this subchapter. The 31 attorney general shall be reimbursed up to two hundred fifteen 32 four hundred fifty thousand dollars annually from the fund 33 for services provided related to the fund. The commissioner 34 of insurance shall consider the reimbursement to the attorney 35 -20- LSB 1005SV (3) 89 as/tm 20/ 26
S.F. 599 general as an outstanding liability when making a determination 1 of funding availability under section 85.65A, subsection 2 2 . In making an award under this subchapter, the workers’ 3 compensation commissioner shall specifically find the amount 4 the injured employee shall be paid weekly, the number of weeks 5 of compensation which shall be paid by the employer, the date 6 upon which payments out of the fund shall begin, and, if 7 possible, the length of time the payments shall continue. 8 Sec. 22. 2014 Iowa Acts, chapter 1138, section 21, as 9 amended by 2016 Iowa Acts, chapter 1137, section 18, 2017 Iowa 10 Acts, chapter 167, section 24, and 2019 Iowa Acts, chapter 163, 11 section 26, is amended to read as follows: 12 SEC. 21. CONSUMER EDUCATION AND LITIGATION 13 FUND. Notwithstanding section 714.16C , for each fiscal 14 year of the period beginning July 1, 2014, and ending June 15 30, 2021 2023 , the annual appropriations in section 714.16C , 16 are increased from $1,125,000 to $1,875,000, and $75,000 to 17 $125,000 respectively. 18 DIVISION III 19 PUBLIC SAFETY 20 Sec. 23. NEW SECTION . 80.6A Peace officers —— health 21 insurance. 22 1. a. (1) Notwithstanding any provision to the contrary, 23 peace officers employed within the department that are not 24 covered under a collective bargaining agreement who were at 25 any time eligible to be enrolled in the group health insurance 26 plan that is negotiated under chapter 20 between the state 27 and the state police officers council labor union and who 28 elect to participate in a group health insurance plan provided 29 by the state, shall only be permitted, if not prohibited to 30 participate pursuant to paragraph “b” , to participate in the 31 group health insurance plan that is negotiated under chapter 20 32 between the state and the state police officers council labor 33 union for peace officers subject to the requirements of this 34 subsection. In addition, a peace officer who was covered under 35 -21- LSB 1005SV (3) 89 as/tm 21/ 26
S.F. 599 a collective bargaining agreement and who becomes a manager 1 or supervisor and is no longer covered by the agreement shall 2 not lose group health insurance benefits as provided by the 3 agreement. 4 (2) Notwithstanding any provision to the contrary, a peace 5 officer participating in the group health insurance plan 6 pursuant to this paragraph “a” shall have the option, upon 7 retirement, to continue participation in the group health 8 insurance plan pursuant to section 509A.13 subject to the 9 requirements of this section. However, a peace officer who was 10 not covered under a collective bargaining agreement and not 11 participating in the group health insurance plan as provided by 12 this section at the time of retirement shall not be allowed to 13 participate in the group health insurance plan negotiated under 14 chapter 20 between the state and the state police officers 15 council upon retirement. 16 b. By September 1, 2021, and by September 1 of each year 17 thereafter if the ability to participate in the group health 18 insurance plan provided by this subsection is offered for that 19 year, the governing body of the state police officers council 20 shall have the right to offer or terminate the ability to 21 participate in the group health insurance plan provided by this 22 subsection for the subsequent calendar year and shall provide 23 written notice of the council’s decision to the department by 24 September 1, if applicable. The Iowa state patrol supervisors 25 association shall have the opportunity to address the governing 26 board of the state police officers council concerning the 27 decision of the governing board under this paragraph on or 28 after July 1 but before September 1 of each calendar year, if 29 applicable. A decision to terminate the ability to participate 30 in the group health insurance plan provided by this subsection 31 is irrevocable and applies for all subsequent calendar years. 32 2. The department shall be authorized to retain any savings 33 to the department for peace officers participating in the group 34 health insurance plan pursuant to subsection 1 from moneys 35 -22- LSB 1005SV (3) 89 as/tm 22/ 26
S.F. 599 appropriated to the department. 1 Sec. 24. NEW SECTION . 80.6B Group health insurance plan 2 reporting —— state police officers council. 3 Prior to July 1 of each calendar year if group health 4 insurance is offered to employees that are not covered by a 5 collective bargaining agreement, the provider of the group 6 health insurance plan negotiated under chapter 20 between the 7 state and the state police officers council labor union shall 8 submit a report to the state police officers council and the 9 departments of public safety and natural resources necessary 10 for purposes of complying with the requirements of sections 11 80.6A and 456A.13A. The report shall include usage statistics 12 that separately account for employees in the group health 13 insurance plan covered by a collective bargaining agreement 14 negotiated by the state police officers council and those 15 employees that are not covered by a collective bargaining 16 agreement and shall include any information that led to any 17 premium rate increase or decrease for the following calendar 18 year. 19 Sec. 25. NEW SECTION . 456.13A Full-time officers —— health 20 insurance. 21 1. a. (1) Notwithstanding any provision to the contrary, 22 full-time officers as defined in section 456A.13 that are not 23 covered under a collective bargaining agreement who were at 24 any time eligible to be enrolled in the group health insurance 25 plan that is negotiated under chapter 20 between the state 26 and the state police officers council labor union and who 27 elect to participate in a group health insurance plan provided 28 by the state, shall only be permitted, if not prohibited to 29 participate pursuant to paragraph “b” , to participate in the 30 group health insurance plan that is negotiated under chapter 31 20 between the state and the state police officers council 32 labor union for full-time officers subject to the requirements 33 of this subsection. In addition, a full-time officer who 34 was covered under a collective bargaining agreement and who 35 -23- LSB 1005SV (3) 89 as/tm 23/ 26
S.F. 599 becomes a manager or supervisor and is no longer covered by 1 the agreement shall not lose group health insurance benefits 2 as provided by the agreement. 3 (2) Notwithstanding any provision to the contrary, a 4 full-time officer participating in the group health insurance 5 plan pursuant to this paragraph “a” shall have the option, 6 upon retirement, to continue participation in the group health 7 insurance plan pursuant to section 509A.13 subject to the 8 requirements of this section. However, a full-time officer who 9 was not covered under a collective bargaining agreement and not 10 participating in the group health insurance plan as provided by 11 this section at the time of retirement shall not be allowed to 12 participate in the group health insurance plan negotiated under 13 chapter 20 between the state and the state police officers 14 council upon retirement. 15 b. By September 1, 2021, and by September 1 of each year 16 thereafter if the ability to participate in the group health 17 insurance plan provided by this subsection is offered for that 18 year, the governing body of the state police officers council 19 shall have the right to offer or terminate the ability to 20 participate in the group health insurance plan provided by this 21 subsection for the subsequent calendar year and shall provide 22 written notice of the council’s decision to the department 23 by September 1, if applicable. A decision to terminate the 24 ability to participate in the group health insurance plan 25 provided by this subsection is irrevocable and applies for all 26 subsequent calendar years. 27 2. The department shall calculate the savings to the 28 department for full-time officers employed in the law 29 enforcement bureau of the department who are participating in 30 the group health insurance plan pursuant to subsection 1. The 31 department shall transfer to the state fish and game protection 32 fund created in section 456A.17 from moneys appropriated to the 33 department an amount equal to the savings calculated by the 34 department. S.F. 599 to retain any savings to the department for full-time officers 1 who are not employed in the law enforcement bureau of the 2 department participating in the group health insurance plan 3 pursuant to subsection 1 from moneys appropriated to the 4 department. 5 EXPLANATION 6 The inclusion of this explanation does not constitute agreement with 7 the explanation’s substance by the members of the general assembly. 8 This bill relates to and makes appropriations to the justice 9 system. 10 The bill makes appropriations from the general fund of 11 the state for FY 2021-2022 to the departments of justice, 12 corrections, public defense, public safety, and homeland 13 security and emergency management, and the Iowa law enforcement 14 academy, office of the state public defender, board of parole, 15 Iowa state civil rights commission, and the criminal and 16 juvenile justice planning division of the department of human 17 rights. 18 The bill appropriates moneys from the department of commerce 19 revolving fund for FY 2021-2022 to the office of consumer 20 advocate of the department of justice. 21 The bill appropriates moneys from the gaming enforcement 22 revolving fund for FY 2021-2022 to the department of public 23 safety. 24 The bill appropriates moneys from the 911 emergency 25 communications fund for FY 2021-2022 to the department of 26 homeland security and emergency management. 27 The bill appropriates moneys from the consumer education and 28 litigation fund for FY 2021-2022 to the department of justice 29 for farm mediation services and salaries, support, maintenance, 30 and miscellaneous purposes for criminal prosecutions, criminal 31 appeals, and performing certain duties. 32 ATTORNEY GENERAL. Currently, the attorney general is 33 required to appoint a staff member to represent the treasurer 34 of state and the workers’ compensation fund in all proceedings 35 -25- LSB 1005SV (3) 89 as/tm 25/ 26
S.F. 599 and matters arising under the second injury compensation Act. 1 The bill provides that the attorney general shall be reimbursed 2 up to $450,000 annually from the fund for services provided 3 related to the fund. 4 CONSUMER EDUCATION AND LITIGATION FUND. The bill provides 5 that notwithstanding Code section 714.16C, for each fiscal 6 year of the period beginning July 1, 2014, and ending June 7 30, 2023, the annual appropriations in Code section 714.16C, 8 are increased from $1,125,000 to $1,875,000, and $75,000 to 9 $125,000, respectively. 10 PUBLIC SAFETY. The bill allows peace officers or full-time 11 officers employed within the department of public safety and 12 the department of natural resources that are not covered 13 under a collective bargaining agreement to have the option 14 to participate in the group health insurance plan that is 15 negotiated between the state and the state police officers 16 council labor union (SPOC) for peace officers and full-time 17 officers. A peace officer or full-time officer participating 18 in the group health insurance plan shall have the option, upon 19 retirement, to continue participation in the group health 20 insurance plan pursuant to Code section 509A.13 subject to 21 the requirements of this Code section. The department is 22 authorized to retain any savings to the department for peace 23 officers, and full-time officers not employed in the law 24 enforcement bureau of the department, participating in the 25 group health insurance plan from moneys appropriated to the 26 department. The department shall calculate the savings to 27 the department for full-time officers employed in the law 28 enforcement bureau of the department who are participating in 29 the group health insurance plan. The department is required to 30 transfer to the state fish and game protection fund created in 31 Code section 456A.17 from moneys appropriated to the department 32 an amount equal to the savings calculated by the department. 33 -26- LSB 1005SV (3) 89 as/tm 26/ 26
