FARMERS WITH DISABILITIES PROGRAM. 9 1. There is appropriated from the general fund of the state 10 to the department of agriculture and land stewardship for the 11 fiscal year beginning July 1, 2021, and ending June 30, 2022, 12 the following amount, or so much thereof as is necessary, to be 13 used for the purposes designated: 14 For purposes of supporting a program for farmers with 15 disabilities: 16 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 180,000 17 2. The moneys appropriated in subsection 1 shall be used for 18 the public purpose of providing a grant to a national nonprofit 19 organization with over 80 years of experience in assisting 20 children and adults with disabilities and special needs. The 21 moneys shall be used to support a nationally recognized program 22 that began in 1986 and has been replicated in at least 30 other 23 states, but which is not available through any other entity 24 in this state, and that provides assistance to farmers with 25 disabilities in all 99 counties to allow the farmers to remain 26 in their own homes and be gainfully engaged in farming through 27 provision of agricultural worksite and home modification 28 consultations, peer support services, services to families, 29 information and referral, and equipment loan services. 30 3. Notwithstanding section 8.33 , moneys appropriated in 31 this section that remain unencumbered or unobligated at the 32 close of the fiscal year shall not revert but shall remain 33 available for expenditure for the purposes designated until the 34 close of the succeeding fiscal year. 35 -4- LSB 1001SV (1) 89 da/tm 4/ 26
S.F. 598 Sec. 9. LOESS HILLS DEVELOPMENT AND CONSERVATION FUND —— 1 HUNGRY CANYONS ACCOUNT AND LOESS HILLS ALLIANCE ACCOUNT. There 2 is appropriated from the general fund of the state to the 3 department of agriculture and land stewardship for the fiscal 4 year beginning July 1, 2021, and ending June 30, 2022, the 5 following amount, or so much thereof as is necessary, to be 6 used for the purposes designated: 7 1. Of the amount appropriated to the loess hills development 15 and conservation fund in subsection 1, $40,000 shall be 16 allocated to the fund’s loess hills alliance account. 17 3. Not more than 10 percent of the moneys allocated to the 18 fund’s hungry canyons account or loess hills alliance account 19 as provided in subsection 2 may be used for administrative 20 costs. 21 Sec. 10. SOUTHERN IOWA DEVELOPMENT AND CONSERVATION 22 FUND. There is appropriated from the general fund of the state 23 to the department of agriculture and land stewardship for the 24 fiscal year beginning July 1, 2021, and ending June 30, 2022, 25 the following amount, or so much thereof as is necessary, to be 26 used for the purposes designated: 27 1. WATER QUALITY INITIATIVE —— GENERAL. 24 1. There is appropriated from the general fund of the state 25 to the department of agriculture and land stewardship for the 26 fiscal year beginning July 1, 2021, and ending June 30, 2022, 27 the following amount, or so much thereof as is necessary, to be 28 used for the purposes designated: 29 For deposit in the water quality initiative fund created in 30 section 466B.45 , for purposes of supporting the water quality 31 initiative administered by the division of soil conservation 32 and water quality as provided in section 466B.42 , including 33 salaries, support, maintenance, and miscellaneous purposes: 34 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,000,000 35 -6- LSB 1001SV (1) 89 da/tm 6/ 26

The moneys appropriated in subsection 1 shall be 1 used to support projects in subwatersheds as designated by the 2 division that are part of high-priority watersheds identified 3 by the water resources coordinating council established 4 pursuant to section 466B.3 . 5 b. The moneys appropriated in subsection 1 shall be used to 6 support projects in watersheds generally, including regional 7 watersheds, as designated by the division and high-priority 8 watersheds identified by the water resources coordinating 9 council established pursuant to section 466B.3. 10 3. In supporting projects in subwatersheds and watersheds 11 as provided in subsection 2, all of the following shall apply: 12 a. The demonstration projects shall utilize water quality 13 practices as described in the Iowa nutrient reduction strategy 14 as defined in section 455B.171 . 15 b. The division shall implement demonstration projects as 16 provided in paragraph “a” by providing for participation by 17 persons who hold a legal interest in agricultural land used in 18 farming. To every extent practical, the division shall provide 19 for collaborative participation by such persons who hold a 20 legal interest in agricultural land located within the same 21 subwatershed. 22 c. The division shall implement a demonstration project on 23 a cost-share basis as determined by the division. However, 24 except for edge-of-field practices, the state’s share of the 25 amount shall not exceed 50 percent of the estimated cost of 26 establishing the practice as determined by the division or 27 50 percent of the actual cost of establishing the practice, 28 whichever is less. 29 d. The demonstration projects shall be used to educate other 30 persons about the feasibility and value of establishing similar 31 water quality practices. The division shall promote field day 32 events for purposes of allowing interested persons to establish 33 water quality practices on their agricultural land. 34 e. The division shall conduct water quality evaluations 35 -7- LSB 1001SV (1) 89 da/tm 7/ 26
S.F. 598 within supported subwatersheds. Within a reasonable period 1 after accumulating information from such evaluations, the 2 division shall create an aggregated database of water quality 3 practices. Any information identifying a person holding a 4 legal interest in agricultural land or specific agricultural 5 land shall be a confidential record under section 22.7 . 6 4. The moneys appropriated in subsection 1 shall be used 7 to support education and outreach in a manner that encourages 8 persons who hold a legal interest in agricultural land used for 9 farming to implement water quality practices, including the 10 establishment of such practices in watersheds generally, and 11 not limited to subwatersheds or high-priority watersheds. 12 5. The moneys appropriated in subsection 1 may be used 13 to contract with persons to coordinate the implementation of 14 efforts provided in this section. 15 6. The moneys appropriated in subsection 1 may be used by 16 the department to support urban soil and water conservation 17 efforts, which may include but are not limited to management 18 practices related to bioretention, landscaping, the use of 19 permeable or pervious pavement, and soil quality restoration. 20 The moneys shall be allocated on a cost-share basis as provided 21 in chapter 161A. 22 7. Notwithstanding any other provision of law to the 23 contrary, the department may use moneys appropriated in 24 subsection 1 to carry out the provisions of this section on a 25 cost-share basis in combination with other moneys available to 26 the department from a state or federal source. 27 8. Not more than 10 percent of the moneys appropriated in 28 this section may be used to pay for the costs of administering 29 and implementing the water quality initiative by the 30 department’s division of soil conservation and water quality as 31 provided in section 466B.42 and this section. 32 DIVISION III 33 DEPARTMENT OF NATURAL RESOURCES 34 Sec. 14. The department shall submit a report each quarter of the 19 fiscal year to the legislative services agency, the department 20 of management, the members of the joint appropriations 21 subcommittee on agriculture and natural resources, and the 22 chairpersons and ranking members of the senate and house 23 committees on appropriations. The report shall describe in 24 detail the expenditure of moneys appropriated under this 25 section to support the department’s administration, regulation, 26 and programs. 27 Sec. 15. STATE FISH AND GAME PROTECTION FUND —— REGULATION 28 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 29 1. There is appropriated from the state fish and game 30 protection fund created pursuant to section 456A.17 to the 31 department of natural resources for the fiscal year beginning 32 July 1, 2021, and ending June 30, 2022, the following amount, 33 or so much thereof as is necessary, to be used for the purposes 34 designated: 35 -9- LSB 1001SV (1) 89 da/tm 9/ 26

Notwithstanding section 455A.10 , the department may use 8 the unappropriated balance remaining in the state fish and game 9 protection fund to provide for the funding of health and life 10 insurance premium payments from unused sick leave balances of 11 conservation peace officers employed in a protection occupation 12 who retire, pursuant to section 97B.49B . 13 3. Notwithstanding section 455A.10 , the department of 14 natural resources may use the unappropriated balance remaining 15 in the state fish and game protection fund for the fiscal 16 year beginning July 1, 2021, and ending June 30, 2022, as is 17 necessary to fund salary adjustments for departmental employees 18 for which the general assembly has made an operating budget 19 appropriation in subsection 1. 20 Sec. 16. GROUNDWATER PROTECTION FUND —— WATER 21 QUALITY. Iowa state university of science and technology 1 shall not reduce the amount that it allocates to support the 2 college of veterinary medicine from any other source due to the 3 appropriation made in this section. 4 b. Paragraph “a” does not apply to a reduction made to 5 support the college of veterinary medicine, if the same 6 percentage of reduction imposed on the college of veterinary 7 medicine is also imposed on all of Iowa state university of 8 science and technology’s budget units. 9 3. If by June 30, 2022, Iowa state university of science and 10 technology fails to allocate the moneys appropriated in this 11 section to the college of veterinary medicine in accordance 12 with this section, the moneys appropriated in this section for 13 that fiscal year shall revert to the general fund of the state. 14 Sec. 22. LIVESTOCK DISEASE RESEARCH. There is appropriated 15 from the general fund of the state to Iowa state university 16 of science and technology for the fiscal year beginning July 17 1, 2021, and ending June 30, 2022, the following amount, or 18 so much thereof as is necessary, to be used for the purposes 19 designated: 20 1. As a condition of the appropriation made in subsection 17 1, the state university of Iowa shall not reduce the amount 18 allocated to support Iowa’s center for agricultural safety from 19 any other source due to the appropriation made in subsection 1. 20 4. If by June 30, 2022, the state university of Iowa fails 21 to use the moneys appropriated in subsection 1 in accordance 22 with the purposes and conditions of this subsection, any 23 unencumbered and unobligated moneys appropriated in subsection 24 1 for the fiscal year beginning July 1, 2021, and ending June 25 30, 2022, shall revert to the general fund of the state. In 26 addition, if moneys are required to be reverted pursuant to 27 section 8.33, the state university of Iowa shall transfer 28 to the general fund from any otherwise unencumbered and 29 unobligated moneys from any other general fund appropriation 30 or from any moneys available from other funding sources an 31 amount equal to the amount appropriated in subsection 1 less 32 any amount reverted to the general fund of the state pursuant 33 to section 8.33. 34 DIVISION VI 35 -14- LSB 1001SV (1) 89 da/tm 14/ 26

Except as provided in subsection 2, and notwithstanding 2 section 8.33 , moneys appropriated for the fiscal year beginning 3 July 1, 2021, in this division of this Act that remain 4 unencumbered or unobligated at the close of the fiscal year 5 shall not revert but instead shall remain available to be used 6 for the purposes designated until the close of the succeeding 7 fiscal year, or until the project for which the appropriation 8 was made is completed, whichever is earlier. 9 2. The moneys appropriated in subsection 1 shall be 1 used to support projects in subwatersheds as designated by the 2 division that are part of high-priority watersheds identified 3 by the water resources coordinating council established 4 pursuant to section 466B.3 . 5 b. The moneys appropriated in subsection 1 shall be used to 6 support projects in watersheds generally, including regional 7 watersheds, as designated by the division and high-priority 8 watersheds identified by the water resources coordinating 9 council established pursuant to section 466B.3. 10 3. In supporting projects in subwatersheds and watersheds 11 as provided in subsection 2, all of the following shall apply: 12 a. The demonstration projects shall utilize water quality 13 practices as described in the Iowa nutrient reduction strategy 14 as defined in section 455B.171 . 15 b. The division shall implement demonstration projects as 16 provided in paragraph “a” by providing for participation by 17 persons who hold a legal interest in agricultural land used in 18 farming. To every extent practical, the division shall provide 19 for collaborative participation by such persons who hold a 20 legal interest in agricultural land located within the same 21 subwatershed. 22 c. The division shall implement a demonstration project on 23 a cost-share basis as determined by the division. However, 24 except for edge-of-field practices, the state’s share of the 25 amount shall not exceed 50 percent of the estimated cost of 26 establishing the practice as determined by the division or 27 50 percent of the actual cost of establishing the practice, 28 whichever is less. 29 d. The demonstration projects shall be used to educate other 30 persons about the feasibility and value of establishing similar 31 water quality practices. The division shall promote field day 32 events for purposes of allowing interested persons to establish 33 water quality practices on their agricultural land. 34 e. The division shall conduct water quality evaluations 35 -20- LSB 1001SV (1) 89 da/tm 20/ 26
S.F. 598 within supported subwatersheds. Within a reasonable period 1 after accumulating information from such evaluations, the 2 division shall create an aggregated database of water quality 3 practices. Any information identifying a person holding a 4 legal interest in agricultural land or specific agricultural 5 land shall be a confidential record under section 22.7 . 6 4. The moneys appropriated in subsection 1 shall be used 7 to support education and outreach in a manner that encourages 8 persons who hold a legal interest in agricultural land used for 9 farming to implement water quality practices, including the 10 establishment of such practices in watersheds generally, and 11 not limited to subwatersheds or high-priority watersheds. 12 5. The moneys appropriated in subsection 1 may be used 13 to contract with persons to coordinate the implementation of 14 efforts provided in this section. 15 6. The moneys appropriated in subsection 1 may be used by 16 the department to support urban soil and water conservation 17 efforts, which may include but are not limited to management 18 practices related to bioretention, landscaping, the use of 19 permeable or pervious pavement, and soil quality restoration. 20 The moneys shall be allocated on a cost-share basis as provided 21 in chapter 161A. 22 7. Notwithstanding any other provision of law to the 23 contrary, the department may use moneys appropriated in 24 subsection 1 to carry out the provisions of this section on a 25 cost-share basis in combination with other moneys available to 26 the department from a state or federal source. 27 8. Not more than 10 percent of the moneys appropriated in 28 this section may be used to pay for the costs of administering 29 and implementing the water quality initiative by the 30 department’s division of soil conservation and water quality as 31 provided in section 466B.42 and this section. 32 DIVISION VIII 33 IOWA RESOURCES ENHANCEMENT AND PROTECTION FUND 34 Sec. 29. Notwithstanding section 455A.19, 9 subsection 1, paragraph “a”, subparagraph (1), of the moneys 10 allocated to the open spaces account of the Iowa resources 11 enhancement and protection fund, up to $1,000,000 may be 12 used by the department of natural resources for state park 13 maintenance and repair for the fiscal year beginning July 1, 14 2021, and ending on June 30, 2022. 15 DIVISION IX 16 CODE CHANGES 17 Sec. 31. NEW SECTION . 456.5A Long-range budget plan. 18 1. As used in this section, “planning period” means a period 19 comprised of five consecutive fiscal years each beginning July 20 1 and ending June 30. 21 2. Not later than January 10, 2022, and not later than 22 January 10 of each subsequent five-year period, the state 23 geologist shall publish a new long-range budget plan for 24 the next planning period. The long-range budget plan shall 25 describe how moneys appropriated, expected to the appropriated, 26 or otherwise available or expected to be available to the 27 Iowa geological survey for each fiscal year of that planning 28 period are to be expended in a manner that best allows the 29 Iowa geographic survey to exercise its powers and carry out 30 its duties or functions. The long-range budget plan shall 31 include any performance goals and measures required by law 32 or established by the state geologist. The state geologist 33 shall annually evaluate the Iowa geological survey’s progress 34 in attaining those performance goals and shall revise the 35 -22- LSB 1001SV (1) 89 da/tm 22/ 26
S.F. 598 long-term budget plan as the state geologist determines 1 necessary or desirable. 2 Sec. 32. Section 456.7, Code 2021, is amended to read as 3 follows: 4 456.7 Annual report. 5 The On or before January 10 of each year, the state geologist 6 shall , annually, at the time provided by law, make submit to 7 the governor and the general assembly a full report of the work 8 in of the Iowa geographic survey performed during the preceding 9 year , which . The report shall include a summary of its current 10 long-range budget plan as provided in section 456.5A. The 11 report may be accompanied by such other reports and papers 12 documents as may be considered the state geologist determines 13 is necessary or desirable for publication. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 GENERAL. This bill relates to agriculture and natural 18 resources by making appropriations for the fiscal year 19 2021-2022 to support related entities, including the department 20 of agriculture and land stewardship (DALS), the department of 21 natural resources (DNR), and Iowa state university (ISU), and 22 the university of Iowa (UI). 23 The bill primarily appropriates moneys to DALS and DNR. 24 The appropriations are made to support those departments for 25 administration, regulation, and support of programs. The bill 26 requires the departments to submit quarterly reports to the 27 general assembly and department of management regarding the 28 expenditure of appropriated moneys. The bill also provides 29 moneys to support specific programs or projects administered 30 by those departments. The bill appropriates moneys from a 31 number of sources, including the general fund of the state 32 (general fund), the state fish and game protection fund, the 33 groundwater protection fund, and the environment first fund 34 (EFF). Appropriations are made from a number of sources to 35 -23- LSB 1001SV (1) 89 da/tm 23/ 26
S.F. 598 support the water quality initiative (WQI). 1 The bill is organized into divisions. 2 DALS —— GENERAL FUND APPROPRIATIONS. The bill appropriates 3 moneys to DALS from the general fund in order to support its 4 administrative divisions, including consumer protection and 5 industry services, soil conservation, and food safety and 6 animal health. Moneys are transferred to ISU to support its 7 midwest grape and wine institute. 8 DALS —— MISCELLANEOUS FUNDS —— DESIGNATED APPROPRIATIONS. 9 The bill appropriates moneys from several sources to support a 10 number of designated purposes, including moneys derived from 11 unclaimed winnings from horse and dog races, for administration 12 and enforcement of racing regulations; and moneys credited 13 to the renewable fuel infrastructure fund, for purposes of 14 regulating motor fuel. 15 DALS —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill 16 makes special appropriations from the general fund to DALS in 17 order to support specific purposes including milk inspection, 18 the local food and farm program, an agricultural education 19 organization, foreign animal disease preparedness, assistance 20 to farmers with disabilities, projects associated with unique 21 natural resources in western and southern counties, grain 22 regulation, and a value added agriculture grant program. 23 DALS —— GENERAL FUND APPROPRIATIONS —— WATER QUALITY. The 24 bill appropriates moneys from the general fund to DALS for 25 deposit in the water quality initiative fund, to support the 26 WQI including high-priority watershed projects. 27 DNR —— GENERAL FUND AND OTHER MAJOR FUNDS APPROPRIATIONS. 28 The bill makes appropriations from a number of funds to DNR in 29 order to support its administrative divisions involving natural 30 resources and environmental protection from the general fund, 31 the state fish and game protection fund, and the groundwater 32 protection fund. 33 DNR —— MISCELLANEOUS FUNDS —— DESIGNATED APPROPRIATIONS. 34 The bill appropriates moneys to DNR from a number of sources 35 -24- LSB 1001SV (1) 89 da/tm 24/ 26
S.F. 598 to support designated purposes, including moneys deposited in 1 the special snowmobile fund to provide for administering and 2 enforcing the state snowmobile programs; and moneys deposited 3 in the unassigned revenue fund for purposes of paying for 4 administration of DNR’s underground storage tanks section. 5 DNR —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill makes 6 special appropriations from the general fund to DNR in order to 7 support specific purposes including floodplain management, dam 8 safety and forestry health management programs. 9 ISU —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill 10 appropriates moneys from the general fund to ISU to support the 11 operation of its veterinary diagnostic laboratory and livestock 12 disease research. 13 UI —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill makes 14 appropriations from the general fund to UI to support the 15 operations of Iowa’s center for agricultural safety and health 16 which is part of UI’s college of public health. 17 DALS, DNR, AND UI —— EFF —— GENERAL APPROPRIATIONS. The 18 bill appropriates moneys from the EFF to support a number of 19 programs administered by DALS, DNR, and UI. For DALS, the 20 moneys are appropriated to support programs involving soil 21 conservation, watershed protection and nutrient management, 22 and the loess hills development and conservation fund. For 23 DNR, moneys are appropriated to support programs involving 24 state parks, geographic information systems, water quality 25 monitoring, public water supplies, regulation of animal feeding 26 operations, air quality, and floodplain management and dam 27 safety. For UI, moneys are appropriated to support the Iowa 28 geological survey. The bill includes provisions that delay the 29 reversion of these moneys. 30 EFF —— SPECIAL APPROPRIATIONS FOR WQI. The bill 31 appropriates moneys from the EFF to the water quality 32 initiative fund subject to the same conditions applicable to 33 moneys appropriated to the fund from the general fund. 34 IOWA RESOURCES ENHANCEMENT AND PROTECTION (REAP) FUND —— EFF 35 -25- LSB 1001SV (1) 89 da/tm 25/ 26

An amount 1 of moneys is appropriated from the EFF to the REAP fund instead 2 of the $20 million otherwise required to be appropriated to 3 the fund from the general fund. Notwithstanding the standing 4 allocation from the REAP fund to the open spaces account, DNR 5 may use moneys in the account for state park maintenance and 6 repair. 7 CODE CHANGES.
