There is appropriated from the general fund of the state 5 to the department of cultural affairs for the fiscal year 6 beginning July 1, 2021, and ending June 30, 2022, the following 7 amounts, or so much thereof as is necessary, to be used for the 8 purposes designated: 9 a. GOALS AND ACCOUNTABILITY —— ECONOMIC DEVELOPMENT. 19 1. For the fiscal year beginning July 1, 2021, the goals 20 for the economic development authority shall be to expand and 21 stimulate the state economy, increase the wealth of Iowans, and 22 increase the population of the state. 23 2. To achieve the goals in subsection 1, the economic 24 development authority shall do all of the following for the 25 fiscal year beginning July 1, 2021: 26 a. Concentrate its efforts on programs and activities that 27 result in commercially viable products and services. 28 b. Adopt practices and services consistent with free 29 market, private sector philosophies. 30 c. Ensure economic growth and development throughout the 31 state. 32 d. Work with businesses and communities to continually 33 improve the economic development climate along with the 34 economic well-being and quality of life for Iowans. 35 -2- LSB 1002SV (2) 89 ko/tm 2/ 22
S.F. 595 e. Coordinate with other state agencies to ensure that they 1 are attentive to the needs of an entrepreneurial culture. 2 f. Establish a strong and aggressive marketing image to 3 showcase Iowa’s workforce, existing industry, and potential. 4 A priority shall be placed on recruiting new businesses, 5 business expansion, and retaining existing Iowa businesses. 6 Emphasis shall be placed on entrepreneurial development through 7 helping entrepreneurs secure capital, and developing networks 8 and a business climate conducive to entrepreneurs and small 9 businesses. 10 g. Encourage the development of communities and quality of 11 life to foster economic growth. 12 h. Prepare communities for future growth and development 13 through development, expansion, and modernization of 14 infrastructure. 15 i. Develop public-private partnerships with Iowa businesses 16 in the tourism industry, Iowa tour groups, Iowa tourism 17 organizations, and political subdivisions in this state to 18 assist in the development of advertising efforts. 19 j. Develop, to the fullest extent possible, cooperative 20 efforts for advertising with contributions from other sources. 21 Sec. 3. ECONOMIC DEVELOPMENT AUTHORITY. 22 1. APPROPRIATION 23 a. S.F. 595 and other divisions the authority may organize. 1 (2) The full-time equivalent positions authorized under 2 this section are funded, in whole or in part, by the moneys 3 appropriated under this subsection or by other moneys received 4 by the authority, including certain federal moneys. 5 (3) For business development operations and programs, 6 international trade, export assistance, workforce recruitment, 7 and the partner state program. 8 (4) For transfer to a fund created pursuant to section 9 15.313 for purposes of financing strategic infrastructure 10 projects. 11 (5) For community economic development programs, tourism 12 operations, community assistance, plans for Iowa green corps 13 and summer youth programs, the main street and rural main 14 street programs, the school-to-career program, the community 15 development block grant, and housing and shelter-related 16 programs. 17 (6) For achieving the goals and accountability, and 18 fulfilling the requirements and duties required under this Act. 19 c. Notwithstanding section 8.33, moneys appropriated in 20 this subsection that remain unencumbered or unobligated at the 21 close of the fiscal year shall not revert but shall remain 22 available for expenditure for the purposes designated in this 23 subsection until the close of the succeeding fiscal year. 24 2. FINANCIAL ASSISTANCE RESTRICTIONS 25 a. A business creating jobs through moneys appropriated in 26 subsection 1 shall be subject to contract provisions requiring 27 new and retained jobs to be filled by individuals who are 28 citizens of the United States who reside within the United 29 States, or any person authorized to work in the United States 30 pursuant to federal law, including legal resident aliens 31 residing in the United States. 32 b. Any vendor who receives moneys appropriated in 33 subsection 1 shall adhere to such contract provisions and 34 provide periodic assurances as the state shall require that the 35 -4- LSB 1002SV (2) 89 ko/tm 4/ 22
S.F. 595 jobs are filled solely by citizens of the United States who 1 reside within the United States, or any person authorized to 2 work in the United States, pursuant to federal law, including 3 legal resident aliens residing in the United States. 4 c. A business that receives financial assistance from 5 the authority from moneys appropriated in subsection 1 shall 6 only employ individuals legally authorized to work in this 7 state. In addition to all other applicable penalties provided 8 by current law, all or a portion of the assistance received 9 by a business which is found to knowingly employ individuals 10 not legally authorized to work in this state is subject to 11 recapture by the authority. 12 3. USES OF APPROPRIATIONS 13 a. From the moneys appropriated in subsection 1, the 14 authority may provide financial assistance in the form of a 15 grant to a community economic development entity for conducting 16 a local workforce recruitment effort designed to recruit former 17 citizens of the state and former students at colleges and 18 universities in the state to meet the needs of local employers. 19 b. From the moneys appropriated in subsection 1, the 20 authority may provide financial assistance to early stage 21 industry companies being established by women entrepreneurs. 22 c. From the moneys appropriated in subsection 1, the 23 authority may provide financial assistance in the form of 24 grants, loans, or forgivable loans for advanced research and 25 commercialization projects involving value-added agriculture, 26 advanced technology, or biotechnology. 27 d. The authority shall not use any moneys appropriated in 28 subsection 1 for purposes of providing financial assistance for 29 the Iowa green streets pilot project or for any other program 30 or project that involves the installation of geothermal systems 31 for melting snow and ice from streets or sidewalks. 32 4. WORLD FOOD PRIZE 33 In lieu of the standing appropriation in section 15.368 , 34 there is appropriated from the general fund of the state to the 35 -5- LSB 1002SV (2) 89 ko/tm 5/ 22

IOWA COMMISSION ON VOLUNTEER SERVICE 5 a. COUNCILS OF GOVERNMENTS —— ASSISTANCE 25 There is appropriated from the general fund of the state 26 to the economic development authority for the fiscal year 27 beginning July 1, 2021, and ending June 30, 2022, the following 28 amount to be used for the purposes of providing financial 29 assistance to Iowa’s councils of governments: 30 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 275,000 31 7. SCIENCE, TECHNOLOGY, ENGINEERING, AND MATHEMATICS 12 INTERNSHIPS 13 a. There is appropriated from the Iowa skilled worker and 14 job creation fund created in section 8.75 to the Iowa economic 15 development authority for the fiscal year beginning July 1, 16 2021, and ending June 30, 2022, the following amount, or so 17 much thereof as is necessary, to be used for the purposes 18 designated: 19 For the funding of internships for students studying in the 20 fields of science, technology, engineering, and mathematics 21 with eligible Iowa employers as provided in section 15.411, 22 subsection 3, paragraph “c”: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,000,000 24 b. No more than 3 percent of the moneys appropriated in this 25 subsection may be used by the authority for costs associated 26 with administration of the internship program. 27 c. FUTURE READY IOWA —— VOLUNTEER MENTORING PROGRAM 33 a. There is appropriated from the Iowa skilled worker and 34 job creation fund created in section 8.75 to the economic 35 -7- LSB 1002SV (2) 89 ko/tm 7/ 22

The authority shall adopt rules pursuant to chapter 34 17A to establish criteria for the distribution of the moneys 35 -8- LSB 1002SV (2) 89 ko/tm 8/ 22
S.F. 595 appropriated in this subsection. 1 Sec. 4. LIMITATIONS OF STANDING APPROPRIATIONS —— FY 2 2021-2022. Notwithstanding the standing appropriations 3 in the following designated sections for the fiscal year 4 beginning July 1, 2021, and ending June 30, 2022, the amounts 5 appropriated from the general fund of the state pursuant to 6 these sections for the following purposes shall not exceed the 7 following amounts: 8 1. FINANCIAL ASSISTANCE REPORTING —— ECONOMIC 16 DEVELOPMENT AUTHORITY. The economic development authority and 17 the department of revenue shall submit a joint annual report 18 to the general assembly no later than November 1, 2021, that 19 details the amount of every direct loan, forgivable loan, 20 tax credit, tax exemption, tax refund, grant, or any other 21 financial assistance awarded to a person during the prior 22 fiscal year by the authority under an economic development 23 program administered by the authority. The report shall 24 identify the county where the project associated with each such 25 award is located. 26 Sec. 6. INSURANCE ECONOMIC DEVELOPMENT. From the 27 moneys collected by the insurance division in excess of the 28 anticipated gross revenues under section 505.7, subsection 29 3 , during the fiscal year beginning July 1, 2021, $100,000 30 shall be transferred to the economic development authority for 31 insurance economic development and international insurance 32 economic development. 33 Sec. 7. IOWA FINANCE AUTHORITY. 34 1. There is appropriated from the general fund of the state 35 -9- LSB 1002SV (2) 89 ko/tm 9/ 22
S.F. 595 to the Iowa finance authority for the fiscal year beginning 1 July 1, 2021, and ending June 30, 2022, the following amount, 2 or so much thereof as is necessary, to be used to provide 3 reimbursement for rent expenses to eligible persons under 4 the home and community-based services rent subsidy program 5 established in section 16.55: 6 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 658,000 7 2. Of the moneys appropriated in this section, not more than 8 $35,000 may be used for administrative costs. 9 3. Notwithstanding section 8.33, moneys appropriated in 10 this section that remain unencumbered or unobligated at the 11 close of the fiscal year shall not revert but shall remain 12 available for expenditure for the purposes designated until the 13 close of the succeeding fiscal year. 14 Sec. 8. IOWA FINANCE AUTHORITY AUDIT. The auditor of state 15 is requested to review the audit of the Iowa finance authority 16 performed by the auditor hired by the authority. 17 Sec. 9. PUBLIC EMPLOYMENT RELATIONS BOARD. 18 1. However, the 22 fee can be taxed as a cost and paid by the losing party, except 23 in cases where it would impose an undue hardship or be unjust 24 under the circumstances. The moneys generated by the filing 25 fee allowed under this subsection are appropriated to the 26 department of workforce development to be used for purposes of 27 administering the division of workers’ compensation. 28 3. WORKFORCE DEVELOPMENT OPERATIONS 29 a. UNEMPLOYMENT COMPENSATION PROGRAM. Notwithstanding 28 section 96.9, subsection 4 , paragraph “a”, moneys credited to 29 the state by the secretary of the treasury of the United 30 States pursuant to section 903 of the Social Security 31 Act are appropriated to the department of workforce 32 development and shall be used by the department for the 33 administration of the unemployment compensation program only. 34 This appropriation shall not apply to any fiscal year 35 -14- LSB 1002SV (2) 89 ko/tm 14/ 22

There is appropriated from the Iowa skilled worker and 3 job creation fund created in section 8.75 to the following 4 departments, agencies, and institutions for the fiscal year 5 beginning July 1, 2021, and ending June 30, 2022, the following 6 amounts, or so much thereof as is necessary, to be used for the 7 purposes designated: 8 a. STATE BOARD OF REGENTS AND REGENTS INSTITUTIONS 23 (1) STATE BOARD OF REGENTS. The report 8 shall be provided in an electronic format and shall include a 9 list of metrics and criteria mutually agreed to in advance by 10 the board of regents and the economic development authority. 11 The metrics and criteria shall allow the governor’s office and 12 the general assembly to quantify and evaluate the progress 13 of the board of regents institutions with regard to their 14 activities, projects, and programs in the areas of technology 15 commercialization, entrepreneurship, regional development, and 16 market research. 17 (2) IOWA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY. S.F. 595 companies. 1 (c) It is the intent of the general assembly that the 2 industrial incentive program focus on Iowa industrial sectors 3 and seek contributions and in-kind donations from businesses, 4 industrial foundations, and trade associations, and that moneys 5 for the center for industrial research and service industrial 6 incentive program shall be allocated only for projects which 7 are matched by private sector moneys for directed contract 8 research or for nondirected research. The match required of 9 small businesses as defined in section 15.102, subsection 10, 10 for directed contract research or for nondirected research 11 shall be $1 for each $3 of state funds. The match required 12 for other businesses for directed contract research or 13 for nondirected research shall be $1 for each $1 of state 14 funds. The match required of industrial foundations or trade 15 associations shall be $1 for each $1 of state funds. 16 (d) Iowa state university of science and technology shall 17 report annually to the general assembly the total amount of 18 private contributions, the proportion of contributions from 19 small businesses and other businesses, and the proportion for 20 directed contract research and nondirected research of benefit 21 to Iowa businesses and industrial sectors. 22 (3) STATE UNIVERSITY OF IOWA. Notwithstanding section 8.33, moneys appropriated in 16 subsection 1, paragraphs “a” and “b”, that remain unencumbered 17 or unobligated at the close of the fiscal year shall not revert 18 but shall remain available for expenditure for the purposes 19 designated until the close of the succeeding fiscal year. 20 DIVISION II 21 BEER AND LIQUOR CONTROL FUND —— TOURISM 22 Sec. 19. Section 123.17, Code 2021, is amended by adding the 23 following new subsection: 24 NEW SUBSECTION . 6A. a. After any transfers provided for in 25 subsections 3, 5, and 6, and before any other transfer to the 26 general fund, the department of commerce shall transfer to the 27 economic development authority from the beer and liquor control 28 fund one million dollars annually for a statewide tourism 29 marketing campaign. 30 b. As part of the statewide tourism marketing campaign 31 pursuant to paragraph “a” , the economic development authority 32 shall issue a single request for proposals to select an entity 33 located in this state for a statewide effort to leverage public 34 and private partnerships to market and promote the state as a 35 -20- LSB 1002SV (2) 89 ko/tm 20/ 22
S.F. 595 travel destination. 1 EXPLANATION 2 The inclusion of this explanation does not constitute agreement with 3 the explanation’s substance by the members of the general assembly. 4 DIVISION I —— FY 2021-2022 APPROPRIATIONS. This bill 5 appropriates moneys for the fiscal year 2021-2022 from the 6 general fund of the state to the department of cultural 7 affairs, the economic development authority, the Iowa 8 finance authority, the public employment relations board, the 9 department of workforce development, Iowa state university of 10 science and technology, the state university of Iowa, and the 11 university of northern Iowa. 12 The bill appropriates moneys for the fiscal year 2021-2022 13 from the Iowa skilled worker and job creation fund created in 14 Code section 8.75 to the economic development authority, the 15 department of workforce development, and the state board of 16 regents and institutions under the control of the board. 17 For the fiscal year 2021-2022, the bill limits standing 18 appropriations established in the Code for the world food 19 prize, certain operational support grants, community cultural 20 grants, and regional tourism marketing. 21 The bill transfers $100,000 of the moneys collected by the 22 insurance division in excess of the anticipated gross revenues 23 under Code section 505.7 to the economic development authority. 24 The bill appropriates moneys for the fiscal year 2021-2022 25 from the special employment security contingency fund to the 26 department of workforce development. 27 The bill appropriates interest earned on the unemployment 28 compensation reserve fund for the fiscal year 2021-2022 to the 29 department of workforce development. 30 Moneys credited to the state by the secretary of treasury 31 of the United States pursuant to section 903 of the Social 32 Security Act are appropriated to the department of workforce 33 development. 34 The auditor of state is requested to review the audit of the 35 -21- LSB 1002SV (2) 89 ko/tm 21/ 22
S.F. 595 Iowa finance authority performed by the auditor hired by the 1 authority. 2 The bill requires the economic development authority and the 3 department of revenue to submit a joint annual report to the 4 general assembly by November 1, 2021, detailing all financial 5 assistance awarded in the prior fiscal year. 6 DIVISION II —— BEER AND LIQUOR CONTROL FUND —— TOURISM. The 7 bill requires the department of commerce to transfer to the 8 economic development authority from the beer and liquor control 9 fund $1 million annually for a statewide tourism marketing 10 campaign.
