S.F. 543 Section 1. NEW SECTION . 153.24 Orthodontia-related 1 services. 2 1. A licensee under the purview of the board who provides 3 treatment for the correction of malpositions of human teeth 4 or the initial use of orthodontic appliances shall not begin 5 orthodontic treatment on a new patient unless one of the 6 following conditions is met: 7 a. The licensee performs an initial in-person or 8 teledentistry examination of the teeth and supporting 9 structures of the new patient prior to beginning orthodontic 10 treatment. 11 b. The new patient provides the licensee with the portion 12 of the dental record taken within the prior six months of 13 an in-person or teledentistry examination of the teeth and 14 supporting structures of the new patient prior to the licensee 15 beginning orthodontic treatment. 16 2. The examination required pursuant to subsection 1 shall 17 include any appropriate conventional or digital radiographs 18 or digital imaging that are necessary to develop a suitable 19 orthodontic diagnosis and treatment plan. 20 3. For the purposes of this section, “new patient” means a 21 person whom a licensee has not examined, for whom a licensee 22 has not provided care, or for whom a licensee has not otherwise 23 provided consultation during the two-year period immediately 24 prior to the patient’s most recent appointment. 25 EXPLANATION 26 The inclusion of this explanation does not constitute agreement with 27 the explanation’s substance by the members of the general assembly. 28 This bill prohibits a licensee under the purview of the 29 dental board who provides treatment for the correction of 30 malpositions of human teeth or the initial use of orthodontic 31 appliances from beginning orthodontic treatment on a new 32 patient unless either the licensee performs an initial 33 in-person or teledentistry examination of the teeth and 34 supporting structures of the new patient prior to beginning 35 -1- LSB 1658SV (1) 89 pf/rh 1/ 2
S.F. 543 orthodontic treatment, or the new patient provides the licensee 1 with the portion of the dental record taken within the prior 2 six months of an in-person or teledentistry examination of the 3 teeth and supporting structures of the new patient prior to 4 the licensee beginning orthodontic treatment. The required 5 examination shall include any appropriate conventional or 6 digital radiographs or digital imaging that are necessary to 7 develop a suitable orthodontic diagnosis and treatment plan. 8 The bill defines “new patient” as a person whom a licensee has 9 not examined, for whom a licensee has not provided care, or for 10 whom a licensee has not otherwise provided consultation during 11 the two-year period immediately prior to the patient’s most 12 recent appointment. 13 -2- LSB 1658SV (1) 89 pf/rh 2/ 2
