Section
1.
ALCOHOLIC
BEVERAGES

RENEWAL
OF
LIQUOR
LICENSES,
WINE
PERMITS,
OR
BEER
PERMITS
FOR

ON-PREMISES
CONSUMPTION.

1.
A
holder
of
a
class
“A”,
class
“B”,
class
“C”,
or
special
4
class
“C”
liquor
control
license,
a
class
"B"
beer
permit,
or
a
5
class
“C”
native
wine
permit
with
an
expiration
date
between
6
May
6,
2020,
and
May
5,
2021,
shall
not
be
required
to
pay
7
the
annual
fee
or
any
additional
applicable
fee
or
surcharge
8
provided
in
chapter
123
upon
renewal
of
the
license
or
permit.

2.
If
the
holder
of
a
class
“A”,
class
“B”,
class
“C”,
or
10
special
class
“C”
liquor
control
license,
a
class
“B”
beer
11
permit,
or
a
class
“C”
native
wine
permit
was
eligible
for
12
deferment
of
the
expiration
of
the
license
or
permit
pursuant
13
to
a
proclamation
of
disaster
emergency
pursuant
to
section
14
29C.6
but
chose
to
renew
the
license
or
permit
and
pay
the
15
annual
fee,
the
alcoholic
beverages
division
of
the
department
16
of
commerce
shall
refund
the
licensee
or
permittee
the
full
17
amount
paid.
Refunds
paid
pursuant
to
this
subsection
shall
be
18
paid
by
the
division
from
the
beer
and
liquor
control
fund
and
19
shall
be
made
before
August
31,
2021.
Local
authorities
shall
20
retain
any
remittances
already
made
pursuant
to
section
123.36,
21
subsection
8,
and
section
123.143,
subsection
1.

The
holder
of
a
class
“C”
native
distilled
spirits
liquor
23
control
license
or
a
class
“D”
liquor
control
license
with
24
an
expiration
date
between
July
1,
2021,
and
June
30,
2022,
25
shall
not
be
required
to
pay
the
annual
fee
or
any
additional
26
applicable
fee
or
surcharge
provided
in
chapter
123
upon
27
renewal
of
the
license.

The
division
shall
remit
to
the
appropriate
local
29
authority
a
sum
equal
to
the
amount
prescribed
in
section
30
123.36,
subsection
8,
for
renewal
fees
for
class
“A”,
class
31
“B”,
class
“C”,
or
special
class
“C”
liquor
licenses,
and
32
a
sum
equal
to
the
amount
prescribed
in
section
123.143,
33
subsection
1,
for
renewal
fees
for
class
“B”
beer
permits
34
with
an
expiration
date
between
May
6,
2020,
and
May
5,
2021,

the
local
authority’s
jurisdiction
that
would
have

otherwise
been
collected
but
for
the
waiver
of
fees
described

in
subsection
1.
Remittances
made
pursuant
to
this
subsection
3
shall
be
paid
by
the
division
from
the
beer
and
liquor
control
4
fund
and
shall
be
made
before
August
31,
2021.

Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
6
importance,
takes
effect
upon
enactment.

EXPLANATION
8
The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
a
holder
of
a
class
“A”,
class
“B”,
11
class
“C”,
or
special
class
“C”
liquor
control
license,
a
class
12
“B”
beer
permit,
or
a
class
“C”
native
wine
permit
with
an
13
expiration
date
between
May
6,
2020,
and
May
5,
2021,
shall
not
14
be
required
to
pay
the
annual
fee
or
any
additional
applicable
15
fee
or
surcharge
provided
in
Code
chapter
123
upon
renewal
16
of
the
license
or
permit.
The
bill
requires
the
alcoholic
17
beverages
division
of
the
department
of
commerce
to
remit
to
18
an
appropriate
local
authority
a
sum
equal
to
certain
amounts
19
prescribed
under
current
law
which
the
local
authority
would
20
have
otherwise
collected
but
for
the
waiver
of
fees
provided
21
in
the
bill.

If
the
holder
of
a
class
“A”,
class
“B”,
class
“C”,
or
23
special
class
“C”
liquor
control
license,
a
class
“B”
beer
24
permit,
or
a
class
“C”
native
wine
permit
was
eligible
for
25
deferment
of
the
expiration
of
the
license
or
permit
pursuant
26
to
a
proclamation
of

chose
to

the

license

permit
and
pay
the
annual
fee,
the
division
must
