S.F. 521 Section 1. Section 80.45, subsection 3, paragraph h, Code 1 2021, is amended to read as follows: 2 h. By November 1, 2017, and annually thereafter, submit 3 a Submit an annual written report by November 1 to the 4 general assembly regarding the office’s activities related 5 to combatting human trafficking and occurrences of human 6 trafficking within this state , and that includes the findings 7 and recommendations provided by the human trafficking task 8 force pursuant to section 80.45B, subsection 5 . 9 Sec. 2. NEW SECTION . 80.45B Human trafficking task force. 10 1. The commissioner shall establish, by January 30, 2022, a 11 task force that shall do all of the following: 12 a. Collaborate with the office to combat human trafficking. 13 b. Examine the extent of human trafficking in the state. 14 c. Identify current initiatives to eliminate human 15 trafficking in the state. 16 d. Identify current services available in the state to 17 victims of human trafficking. 18 e. Utilize research and information available from the 19 United States department of justice and the federal bureau of 20 investigation. 21 f. Develop a human trafficking informational poster that 22 must include the toll-free telephone number for the national 23 human trafficking hotline and that may include telephone 24 numbers of additional resources where human trafficking 25 victims may obtain assistance. The task force shall coordinate 26 with local businesses and nonprofit entities associated with 27 the prevention of human trafficking to encourage voluntary 28 placement of the poster in adult entertainment establishments, 29 rest stops, schools, gas stations, hotels, hospitals, health 30 care clinics, airports, bus stations, and other locations 31 around the state deemed appropriate by the task force. 32 g. Research and recommend a model of rehabilitative services 33 for victims of human trafficking that includes input from 34 law enforcement, social services organizations, the judicial 35 -1- LSB 2452SV (2) 89 ko/rh 1/ 5
S.F. 521 system, mental health professionals, and organizations that 1 work with immigrants. 2 h. Identify barriers that prevent victims of human 3 trafficking from seeking legal assistance or medical attention. 4 i. Investigate and identify potential routes to eliminate 5 human trafficking in the state. 6 j. Investigate and identify potential alternatives to 7 promote recovery, save lives, and protect families and children 8 who may be impacted by human trafficking. 9 k. Report on findings and make recommendations in the report 10 submitted to the general assembly under subsection 5. 11 2. The task force shall consist of the following members: 12 a. The commissioner or the commissioner’s designee. 13 b. The coordinator of the office to combat human 14 trafficking. 15 c. The director of the law enforcement academy or the 16 director’s designee. 17 d. The attorney general or the attorney general’s designee. 18 e. A human trafficking prosecutor from the office of the 19 attorney general. 20 f. The director of the department of corrections or the 21 director’s designee. 22 g. The director of the department of education or the 23 director’s designee. 24 h. The director of the department of human services or the 25 director’s designee. 26 i. The labor commissioner of the division of labor 27 services of the department of workforce development or the 28 commissioner’s designee. 29 j. The director of the department of inspections and appeals 30 or the director’s designee. 31 k. The state fire marshal of the division of state fire 32 marshal of the department of public safety or the marshal’s 33 designee. 34 l. A representative of the division of state patrol of the 35 -2- LSB 2452SV (2) 89 ko/rh 2/ 5
S.F. 521 department of public safety as selected by the commissioner of 1 the department of public safety. 2 m. A representative of the office of motor vehicle 3 enforcement of the department of transportation as selected by 4 the director of the department of transportation. 5 n. The state court administrator or the administrator’s 6 designee. 7 o. The following members who shall be appointed by the 8 governor: 9 (1) The chief of police or head law enforcement official of 10 a city in this state with a population of two hundred thousand 11 or more as determined by the most recent population estimates 12 issued by the United States bureau of census. 13 (2) The chief of police or head law enforcement official of 14 a city in this state with a population of less than two hundred 15 thousand as determined by the most recent population estimates 16 issued by the United States bureau of census. 17 (3) A county sheriff. 18 (4) A county supervisor. 19 (5) A county attorney. 20 (6) A mayor or city manager. 21 (7) An individual involved with the control or prevention of 22 juvenile delinquency in the state. 23 (8) An individual involved with the control or prevention of 24 child abuse in the state. 25 (9) A representative of a statewide volunteer organization 26 devoted exclusively to ending all forms of human trafficking. 27 (10) A representative of a nonprofit organization located 28 in this state that organizes bike rides and other endurance 29 events in multiple cities across the United States to raise 30 awareness and funds to fight human trafficking. 31 (11) A representative of a statewide crisis hotline. 32 (12) A representative of an organization in this state 33 that provides comprehensive services to survivors of human 34 trafficking. 35 -3- LSB 2452SV (2) 89 ko/rh 3/ 5
S.F. 521 (13) A representative of a multidisciplinary team at a child 1 protection center established pursuant to section 135.118. 2 (14) A representative of victim witness services at a county 3 attorney office in the state. 4 (15) Six members from the general public, at least three of 5 whom are female, that includes all of the following: 6 (a) A professional involved with child welfare issues. 7 (b) A professional involved with juvenile delinquency 8 proceedings. 9 (c) An individual who resides in a rural area. 10 (d) An individual who resides in an urban area. 11 (e) A survivor of human trafficking. 12 3. a. The members of the task force appointed by the 13 governor shall serve six-year terms, except that of the members 14 first appointed, four shall serve an initial two-year term, 15 four shall serve an initial four-year term, and six shall serve 16 an initial six-year term. Thereafter, all other appointed 17 members shall serve a six-year term. 18 b. The governor shall appoint a new member to fill a vacancy 19 that occurs before the end of the term of a member appointed by 20 the governor, and the newly appointed member shall serve for 21 the remaining period of the term. 22 c. A member of the task force may be appointed to serve more 23 than one term. 24 d. A member shall not continue to serve on the task force 25 beyond the date at which the member no longer holds the office, 26 employment, or status by which the member had been eligible to 27 serve on the task force. 28 e. A member of the task force appointed by the governor 29 may be removed from the task force for being absent from three 30 regularly scheduled meetings of the task force during any 31 six-month period. 32 f. Eleven members of the task force shall constitute a 33 quorum and the task force shall have the power to act by a 34 majority of the members present at any meeting at which a 35 -4- LSB 2452SV (2) 89 ko/rh 4/ 5
S.F. 521 quorum is present. 1 4. The commissioner or the commissioner’s designee shall 2 serve as the chairperson of the task force. 3 5. The commissioner or the commissioner’s designee shall 4 provide the findings and recommendations of the task force 5 to the coordinator of the office of human trafficking for 6 inclusion in the annual report submitted by the office to the 7 general assembly pursuant to section 80.45, subsection 3, 8 paragraph “h” . 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill directs the commissioner of public safety to 13 establish a human trafficking task force to investigate human 14 trafficking (trafficking) in the state, identify services 15 available for victims of trafficking, identify barriers that 16 prevent victims from seeking legal assistance or medical 17 attention, research and recommend a model of rehabilitative 18 services for victims of trafficking, and accomplish other 19 objectives as detailed in the bill. The required members of 20 the task force are specified in the bill. The bill requires 21 the commissioner to provide the findings and recommendations 22 of the task force to the coordinator of the office of human 23 trafficking for inclusion in the annual report submitted by the 24 office to the general assembly by November 1. 25 -5- LSB 2452SV (2) 89 ko/rh 5/ 5
