Section
1.
NEW
SECTION
.
80.48
Public
safety
equipment
fund.
1
1.
A
public
safety
equipment
fund
is
created
in
the
state
2
treasury
under
the
control
of
the
department.
The
fund
shall
3
consist
of
moneys
appropriated
to
or
deposited
in
the
fund.
4
Moneys
in
the
fund
are
appropriated
to
the
department
for
the
5
purchase,
maintenance,
and
replacement
of
equipment
used
by
6
the
department.
The
department
is
authorized
to
designate
7
moneys
in
the
fund
for
the
future
purchase,
maintenance,
and
8
replacement
of
equipment
used
by
the
department.

2.
Notwithstanding
section
8.33,
moneys
in
the
fund
10
that
remain
unencumbered
or
unobligated
at
the
close
of
a
11
fiscal
year
shall
not
revert
but
shall
remain
available
for
12
expenditure
for
the
purposes
designated.
Notwithstanding
13
section
12C.7,
subsection
2,
interest
or
earnings
on
moneys
in
14
the
fund
shall
be
credited
to
the
fund.

The
department
shall
submit
a
report
to
the
16
co-chairpersons
and
ranking
members
of
the
joint
appropriations
17
subcommittee
on
the
justice
system
and
to
the
legislative
18
services
agency
on
or
before
December
31
of
each
year
which
19
shall
contain
all
of
the
following:
20
a.
A
list
of
all
expenditures
from
the
fund
made
in
the
21
previous
fiscal
year.
22
b.
The
amount
of
moneys
in
the
fund
carried
over
from
23
the
previous
fiscal
year
to
the
current
fiscal
year
and
24
how
the
department
plans
to
use
those
moneys,
including
any
25
expenditures
in
the
current
fiscal
year.

c.
The
amount
of
moneys
in
the
fund
the
department
intends
27
to
carry
over
from
the
current
fiscal
year
to
the
next
fiscal
28
year
and
how
the
department
plans
to
use
those
moneys.
29
d.
A
list
of
all
the
sources
of
moneys
deposited
in
the
fund
30
in
the
previous
fiscal
year.

2.
EFFECTIVE
DATE.
This
Act
takes
effect
January
1,

the

This
bill
creates
a
public
safety
equipment
fund
and

appropriates
the
moneys
in
the
fund
to
the
department
of
public

safety
(DPS)
for
the
purchase,
maintenance,
and
replacement
4
of
equipment
used
by
DPS.
The
fund
consists
of
moneys
5
appropriated
to
or
deposited
in
the
fund.
The
bill
authorizes
6
DPS
to
designate
moneys
in
the
fund
for
future
purchase,
7
maintenance,
and
replacement
of
equipment
used
by
DPS.
The
8
bill
also
provides
for
certain
reporting
requirements
regarding
9
how
the
moneys
in
the
fund
are
used,
including
the
amount
10
carried
over
annually
in
the
fund
and
a
list
of
all
the
sources
11
of
moneys
deposited
in
the
fund.
12
The
bill
takes
effect
January
1,
2022.
