1.
Section
321.176,
Code
2021,
is
amended
by
adding
1
the
following
new
subsection:

SUBSECTION

03.
Any
person
with
a
physical
or
mental

disability
while
operating
a
golf
cart
on
a
city
street
4
pursuant
to
section
321.247
if
the
governing
body
of
the
5
applicable
incorporated
area
does
not
require
the
person
to
6
possess
a
valid
driver’s
license
in
order
to
operate
the
golf
7
cart
on
city
streets.

321.247,
subsection
1,
paragraph
a,
Code

2021,
is
amended
to
read
as
follows:

a.
Incorporated
areas
may,
upon
approval
of
their
governing
11
body,
allow
the
operation
of
golf
carts
on
city
streets
by
12
persons
possessing
a
valid
driver’s
license
or
by
persons
13
with
a
physical
or
mental
disability
who
do
not
possess
14
a
valid
driver’s
license
so
long
as
a
person
possessing
a
15
valid
driver’s
license
is
in
the
golf
cart
while
it
is
being
16
operated
.
However,
a
golf
cart
shall
not
be
operated
upon
a
17
city
street
which
is
a
primary
road
extension
through
the
city
18
but
shall
be
allowed
to
cross
a
city
street
which
is
a
primary
19
road
extension
through
the
city.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

Current
law
permits
the
governing
body
of
an
incorporated
24
area
to
allow
the
operation
of
golf
carts
on
city
streets
25
within
the
incorporated
area
by
persons
possessing
a
valid
26
driver’s
license.
This
bill
permits
the
governing
body
27
of
an
incorporated
area
to
allow
a
person
with
a
physical
28
or
mental
disability
who
does
not
possess
a
valid
driver’s
29
license
to
operate
a
golf
cart
so
long
as
a
person
possessing
30
a
valid
driver’s
license
is
in
the
golf
cart
while
it
is
being
31
operated.
The
bill
exempts
persons
with
a
physical
or
mental
32
disability
from
driver’s
license
requirements
while
operating
33
golf
carts
if
the
governing
body
of
the
applicable
incorporated
34
area
does
not
require
the
person
to
possess
a
valid
driver’s

A
person
who
violates
Code
section
321.247
commits
a
simple
2
misdemeanor
punishable
by
a
scheduled
fine
of
$135.
