S.F. 455 Section 1. Section 331.301, Code 2021, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 18. A county shall not adopt, enforce, 3 or otherwise administer an ordinance, motion, resolution, 4 or amendment, or use any other means, to restrict, impede, 5 regulate, or prohibit, intentionally or effectively, any of the 6 following: 7 a. The provision of natural gas service by a public utility 8 as defined in section 476.1, a competitive natural gas provider 9 as defined in section 476.86, or a retail propane marketer or 10 retail propane dispenser as those terms are defined in section 11 101C.2 to a person, business, municipality, or other wholesale 12 or retail customer within or outside the county. 13 b. The purchase of natural gas or propane from a competitive 14 natural gas provider as defined in section 476.86 or a retail 15 propane marketer or retail propane dispenser as those terms 16 are defined in section 101C.2, or the receipt of natural gas 17 or propane service from a public utility as defined in section 18 476.1, by a person, business, municipality, or other wholesale 19 or retail customer within or outside the county. 20 Sec. 2. Section 364.3, Code 2021, is amended by adding the 21 following new subsection: 22 NEW SUBSECTION . 13. A city shall not adopt, enforce, 23 or otherwise administer an ordinance, motion, resolution, 24 or amendment, or use any other means, to restrict, impede, 25 regulate, or prohibit, intentionally or effectively, any of the 26 following: 27 a. The provision of natural gas service by a public utility 28 as defined in section 476.1, a competitive natural gas provider 29 as defined in section 476.86, or a retail propane marketer or 30 retail propane dispenser as those terms are defined in section 31 101C.2 to a person, business, municipality, or other wholesale 32 or retail customer within or outside the incorporated area of 33 the city. 34 b. S.F. 455 natural gas provider as defined in section 476.86 or a retail 1 propane marketer or retail propane dispenser as those terms 2 are defined in section 101C.2, or the receipt of natural gas 3 or propane service from a public utility as defined in section 4 476.1, by a person, business, municipality, or other wholesale 5 or retail customer within or outside the incorporated area of 6 the city. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill prohibits a county or city from adopting, 11 enforcing, or otherwise administering an ordinance, motion, 12 resolution, or amendment, or using other means, to restrict, 13 impede, regulate, or prohibit (1) the provision of natural 14 gas service by a public utility, a competitive natural gas 15 provider, a retail propane marketer, or a retail propane 16 dispenser to a person, business, municipality, or other 17 wholesale or retail customer within or outside the county or 18 city, and (2) the purchase of natural gas or propane from a 19 competitive natural gas provider, a retail propane marketer, or 20 a retail propane dispenser, or the receipt of natural gas or 21 propane service from a public utility, by a person, business, 22 municipality, or other wholesale or retail customer within or 23 outside the county or city. 24 -2- LSB 2193SV (1) 89 js/ns 2/ 2
