S.F. 392 Section 1. Section 29C.5, Code 2021, is amended to read as 1 follows: 2 29C.5 Department of homeland security and emergency 3 management. 4 The department of homeland security and emergency management 5 is created. The department of homeland security and emergency 6 management shall be responsible for the administration of 7 emergency planning matters, including emergency resource 8 planning in this state, cooperation with, support of, funding 9 for, and tasking of the civil air patrol for missions not 10 qualifying for federal mission status as described in section 11 29A.3A in accordance with operational and funding criteria 12 developed with the adjutant general and coordinated with the 13 civil air patrol, homeland security activities, activities 14 of a joint 911 service board if substituted for a joint 911 15 service board pursuant to section 34A.3, subsection 3A, and 16 coordination of available services and resources in the event 17 of a disaster to include those services and resources of the 18 federal government and private entities. 19 Sec. 2. Section 34A.3, Code 2021, is amended by adding the 20 following new subsection: 21 NEW SUBSECTION . 3A. Department of homeland security and 22 emergency management —— alternative to 911 service board. 23 a. The department of homeland security and emergency 24 management may be substituted for the joint 911 service board 25 required under subsection 1 by the board of supervisors of the 26 county in which the joint 911 service board is maintained. 27 b. The department shall have all of the powers of a joint 28 911 service board if the department is substituted for the 29 joint 911 service board pursuant to paragraph “a” . 30 c. As used in this chapter, “joint 911 service board” 31 includes the department if the department is substituted for 32 the joint 911 service board pursuant to paragraph “a” . 33 EXPLANATION 34 The inclusion of this explanation does not constitute agreement with 35 -1- LSB 2122XS (4) 89 jda/rn 1/ 2
S.F. 392 the explanation’s substance by the members of the general assembly. 1 This bill authorizes the department of homeland security 2 and emergency management to assume the duties of a joint 911 3 service board. 4 The bill provides that the department of homeland security 5 and emergency management may be substituted for a joint 911 6 service board required under Code section 34A.3, subsection 7 1, by the board of supervisors of the county in which the 8 joint 911 service board is maintained. Additionally, the bill 9 provides that the department shall have all of the powers of 10 a joint 911 service board if the department is substituted 11 for the joint 911 service board. The bill establishes that, 12 for purposes of Code section 34A.3, “joint 911 service board” 13 includes the department if the department is substituted for 14 the joint 911 service board. 15 The bill modifies the duties of the department to include the 16 activities of a joint 911 service board if substitution occurs. 17 -2- LSB 2122XS (4) 89 jda/rn 2/ 2
