S.F. 387 Section 1. Section 80B.11B, Code 2021, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4. The director of the academy, subject 3 to the approval of the Iowa state approving agency of the 4 department of education, shall amend its administrative 5 rules pursuant to chapter 17A to require that the academy’s 6 courses of study and training programs meet the requirements 7 of nondegree programs under the Post-9/11 Veterans Educational 8 Assistance Act of 2008, 38 U.S.C. §3301 et seq., as amended. 9 Sec. 2. IOWA LAW ENFORCEMENT ACADEMY —— APPLICATION TO 10 IOWA STATE APPROVING AGENCY. The director of the Iowa law 11 enforcement academy shall, within thirty days of the effective 12 date of this Act, apply to the Iowa state approving agency 13 of the department of education for approval of the academy’s 14 courses of study and training programs as nondegree programs 15 under the Post-9/11 Veterans Educational Assistance Act of 16 2008. 17 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate 18 importance, takes effect upon enactment. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill relates to courses of study and training programs 23 of the Iowa law enforcement academy and federal veterans 24 educational assistance benefits. 25 The bill directs the director of the Iowa law enforcement 26 academy, subject to the approval of the Iowa state approving 27 agency of the department of education, to amend its 28 administrative rules to require that the academy’s courses of 29 study and training programs meet the requirements of nondegree 30 programs under the Post-9/11 Veterans Educational Assistance 31 Act of 2008. Under current law, veterans, service members 32 on active duty, and spouses and children of veterans who 33 died in the line of duty cannot receive reimbursement for 34 academy-related educational and training expenses and fees 35 -1- LSB 1047SV (1) 89 dg/rh 1/ 2
S.F. 387 under this federal law because the academy does not have 1 approved nondegree programs. 2 The bill directs the director of the academy, within 30 days 3 of the effective date of the Act, to apply to the Iowa state 4 approving agency of the department of education for approval 5 of the academy’s courses of study and training programs as 6 nondegree programs under the federal law. The Iowa state 7 approving agency of the Iowa department of education is 8 responsible for approving programs in Iowa eligible to provide 9 benefits to individuals under the Post-9/11 Veterans Education 10 Assistance Act of 2008. 11 The bill creates an immediate effective date upon enactment. 12 -2- LSB 1047SV (1) 89 dg/rh 2/ 2
