1.
NEW
SECTION
.
321.175
Human
trafficking
1
prevention
training
—
commercial
motor
vehicle
operators.

1.
Definition.
As
used
in
this
section,
“human
trafficking”
3
means
the
same
as
defined
in
section
710A.1.
4
2.
Human
trafficking
prevention
training.
5
a.
A
person
seeking
renewal
of
a
commercial
driver’s
license
6
must
certify
to
the
department
that
the
person
successfully
7
completed
approved
human
trafficking
prevention
training
since
8
the
person’s
last
renewal,
or
since
the
initial
issuance
of
the
9
license
if
it
is
the
person’s
first
renewal.
10
b.
The
human
trafficking
prevention
training
shall
be
made
11
available
to
commercial
driver’s
license
renewal
applicants
by
12
the
department
and
may
be
developed
in
conjunction
with
the
13
department
of
public
safety,
another
governmental
agency,
or
a
14
nongovernmental
or
community
organization
that
has
expertise
15
in
the
area
of
human
trafficking.
The
human
trafficking
16
prevention
training
must
be
approved
by
the
commissioner
of
17
public
safety.

3.
Training
content.
The
human
trafficking
prevention
19
training
shall
focus
on
the
accurate
and
prompt
identification
20
and
reporting
of,
or
response
to,
suspected
human
trafficking.
21
The
human
trafficking
prevention
training
shall
include,
at
a
22
minimum,
all
of
the
following:
23
a.
A
general
overview
of
human
trafficking.
24
b.
A
general
overview
of
state
law
on
human
trafficking.
25
c.
The
definition
of
human
trafficking
and
the
commercial
26
exploitation
of
children.
27
d.
Guidance
on
the
difference
between
labor
trafficking
and
28
sex
trafficking.
29
e.
Guidance
on
how
to
recognize
potential
human
trafficking
30
victims.
31
f.
Guidance
on
how
to
recognize
potential
human
traffickers.
32
g.
Guidance
on
how
to
identify
activities
commonly
33
associated
with
human
trafficking.
34
h.
Safe
and
effective
responses
to
human
trafficking

situations,
including
but
not
limited
to
how
to
report

suspected
human
trafficking
to
proper
law
enforcement

officials.

Immunity.
A
commercial
motor
vehicle
operator
who
4
has
completed
approved
human
trafficking
prevention
training
5
pursuant
to
this
section
and
who
acts
in
good
faith
shall
6
be
immune
from
civil
liability
for
reporting
suspected
human
7
trafficking
activities
to
any
law
enforcement
official.

5.
Rules.
The
department
shall
adopt
rules
pursuant
to
9
chapter
17A
as
necessary
to
implement
and
administer
this
10
section.

Sec.
2.
Section
321.188,
subsection
1,
Code
2021,
is
amended
12
by
adding
the
following
new
paragraph:

PARAGRAPH
.
h.
For
a
renewal
of
a
commercial
driver’s
14
license,
certify
that
the
applicant
has
completed
approved
15
human
trafficking
prevention
training
pursuant
to
section
16
321.175.

Sec.
3.
APPLICABILITY.
This
Act
applies
to
commercial
18
driver’s
license
renewals
applied
for
on
or
after
January
1,
19
2022.

EXPLANATION
21
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
22
the
explanation’s
substance
by
the
members
of
the
general
assembly.
23
This
bill
relates
to
human
trafficking
prevention
training
24
for
persons
seeking
to
renew
a
commercial
driver’s
license
25
(CDL).
26
Beginning
January
1,
2022,
a
person
seeking
renewal
of
a
CDL
27
must
certify
to
the
department
of
transportation
(DOT)
that
28
the
person
successfully
completed
approved
human
trafficking
29
prevention
training
(training)
since
the
person’s
last
renewal,
30
or
since
the
initial
issuance
of
the
CDL
if
it
is
the
person’s
31
first
renewal.

The
training
must
be
made
available
to
persons
seeking
33
renewal
of
a
CDL
by
the
DOT
and
may
be
developed
in
conjunction
34
with
the
department
of
public
safety,
another
governmental
35

agency,
or
a
nongovernmental
or
community
organization
that
has
1
expertise
in
the
area
of
human
trafficking.
The
training
must
2
be
approved
by
the
commissioner
of
public
safety.

The
training
must
focus
on
the
accurate
and
prompt
4
identification
and
reporting
of,
and
response
to,
suspected
5
human
trafficking.
The
minimum
requirements
for
the
training
6
content
are
outlined
in
the
bill.
7
A
CDL
operator
who
has
completed
the
training
pursuant
to
the
8
bill
and
who
acts
in
good
faith
is
immune
from
civil
liability
9
for
reporting
suspected
human
trafficking
activities
to
any
law
10
enforcement
official.
11
A
CDL
must
be
renewed
every
eight
years,
with
certain
12
exceptions.
