S.F. 2373 Section 1. Section 455A.14A, subsection 1, paragraphs b and 1 c, Code 2022, are amended to read as follows: 2 b. A nonresident may pay a fee of forty dollars for an 3 annual a pass that grants daily entrance into the state park 4 through one year after the date of purchase for the entire 5 calendar year during which the pass was purchased . The 6 nonresident may purchase a second annual pass for use for a 7 different vehicle for the calendar year for fifteen dollars. 8 c. The department has the authority to charge separate 9 fees to a resident and nonresident for campsite and shelter 10 reservations and for beach access park amenities. The 11 department may also identify situations in which a reservation 12 fee or other access fee will be accepted in lieu of the 13 entrance fee established by this section or when the entrance 14 fee established by this section will not be charged . 15 Sec. 2. Section 455A.14A, subsection 2, Code 2022, is 16 amended to read as follows: 17 2. This section is repealed July 1, 2022 December 31, 2025 . 18 Sec. 3. Section 455A.14B, subsection 1, paragraphs b and c, 19 Code 2022, are amended to read as follows: 20 b. Section 456A.14, Code 2022, is amended to read as 2 follows: 3 456A.14 Temporary appointments —— peace officer status. 4 The director may appoint temporary officers for a period 5 not to exceed six months and may adopt minimum physical, 6 educational, mental, and moral requirements for the temporary 7 officers. Chapter 80B does not apply to the temporary 8 officers. Temporary officers have all the powers of peace 9 officers in the enforcement of this chapter and chapters 321G , 10 321I , 456B , 461A , 461B , 462A , 462B , 465C , 481A , 481B , 482 , 11 483A , 484A , and 484B , sections 455A.14A and 455A.14B, and the 12 trespass laws. 13 Sec. 6. EFFECTIVE DATE. This Act, being deemed of immediate 14 importance, takes effect upon enactment. 15 Sec. 7. APPLICABILITY. This Act applies to passes purchased 16 on and after the effective date of this Act. An annual pass 17 purchased before the effective date of this Act shall remain 18 valid through one year after the date of purchase. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill relates to the lake Manawa and Waubonsie state park 23 user fee pilot programs. The pilot programs currently require 24 the department of natural resources (DNR) to charge entrance 25 fees for each vehicle operated by a nonresident at lake Manawa 26 and Waubonsie state parks. A nonresident may pay a fee for 27 up to two annual passes, one per vehicle, which grant daily 28 entrance into the state park through one year after the date of 29 purchase. The pilot programs authorize DNR to charge separate 30 fees to a resident and nonresident for campsite and shelter 31 reservations and for beach access. Under current law, the 32 pilot programs are repealed July 1, 2022. 33 The bill replaces the annual pass option with a pass that 34 grants daily entrance into the state park for the entire 35 -2- LSB 5684SZ (2) 89 js/rn 2/ 3

S.F. 2373 calendar year during which the pass was purchased. However, 1 an annual pass purchased before the effective date of the bill 2 pursuant to current law shall remain valid through one year 3 after the date of purchase. The bill strikes the provision 4 authorizing DNR to charge separate fees to a resident and 5 nonresident for campsite and shelter reservations and for beach 6 access and instead authorizes DNR to charge separate fees to 7 a resident and nonresident for park amenities. The bill also 8 authorizes DNR to identify situations in which a reservation 9 fee or other fee will be accepted in lieu of an entrance fee or 10 when an entrance fee will not be charged. The bill authorizes 11 a temporary DNR officer employed at the state park to issue 12 a citation to a person who violates a provision of the pilot 13 project. The bill extends the date of the repeal to December 14 31, 2025, and takes effect upon enactment. 15 -3- LSB 5684SZ (2) 89 js/rn 3/ 3
