S.F. 2353 Section 1. Section 455A.14A, subsection 1, paragraphs b and 1 c, Code 2022, are amended to read as follows: 2 b. A nonresident may pay a fee of forty dollars for an 3 annual a pass that grants daily entrance into the state park 4 through one year after the date of purchase for the entire 5 calendar year during which the pass was purchased . The 6 nonresident may purchase a second annual pass for use for a 7 different vehicle for the calendar year for fifteen dollars. 8 c. The department has the authority to charge separate 9 fees to a resident and nonresident for campsite and shelter 10 reservations and for beach access and to identify situations in 11 which a reservation fee or other access fee will be accepted 12 in lieu of the fee established by this section or when a fee 13 established by this section will not be charged . 14 Sec. 2. Section 455A.14A, subsection 2, Code 2022, is 15 amended to read as follows: 16 2. This section is repealed July 1, 2022 December 31, 2025 . 17 Sec. 3. S.F. 2353 follows: 1 456A.14 Temporary appointments —— peace officer status. 2 The director may appoint temporary officers for a period 3 not to exceed six months and may adopt minimum physical, 4 educational, mental, and moral requirements for the temporary 5 officers. Chapter 80B does not apply to the temporary 6 officers. Temporary officers have all the powers of peace 7 officers in the enforcement of this chapter and chapters 321G , 8 321I , 456B , 461A , 461B , 462A , 462B , 465C , 481A , 481B , 482 , 9 483A , 484A , and 484B , sections 455A.14A and 455A.14B, and the 10 trespass laws. 11 Sec. 6. EFFECTIVE DATE. This Act, being deemed of immediate 12 importance, takes effect upon enactment. 13 Sec. 7. APPLICABILITY. This Act applies to passes purchased 14 on and after the effective date of this Act. An annual pass 15 purchased before the effective date of this Act shall remain 16 valid through one year after the date of purchase. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill relates to the lake Manawa and Waubonsie state park 21 user fee pilot programs. The pilot programs currently require 22 the department of natural resources (DNR) to charge entrance 23 fees for each vehicle operated by a nonresident at lake Manawa 24 and Waubonsie state parks. A nonresident may pay a fee for 25 up to two annual passes, one per vehicle, which grant daily 26 entrance into the state park through one year after the date of 27 purchase. The pilot programs authorize DNR to charge separate 28 fees to a resident and nonresident for campsite and shelter 29 reservations and for beach access. Under current law, the 30 pilot programs are repealed July 1, 2022. 31 The bill replaces the annual pass option with a pass that 32 grants daily entrance into the state park for the entire 33 calendar year during which the pass was purchased. However, 34 an annual pass purchased before the effective date of the bill 35 -2- LSB 5684SV (2) 89 js/rn 2/ 3
S.F. 2353 pursuant to current law shall remain valid through one year 1 after the date of purchase. The bill strikes the provision 2 authorizing DNR to charge separate fees to a resident and 3 nonresident for campsite and shelter reservations and for 4 beach access and instead authorizes DNR to identify situations 5 in which a reservation fee or other fee will be accepted in 6 lieu of an entrance fee or when an entrance fee will not be 7 charged. The bill authorizes a temporary DNR officer employed 8 at the state park to issue a citation to a person who violates 9 a provision of the pilot project. The bill extends the date 10 of the repeal to December 31, 2025, and takes effect upon 11 enactment. 12 -3- LSB 5684SV (2) 89 js/rn 3/ 3
