S.F. 2306 Section 1. NEW SECTION . 279.76 Event admission fees. 1 1. For the purposes of this section: 2 a. “Department” means the department of management. 3 b. “Event” means an extracurricular interscholastic contest 4 or competition sponsored or administered by the Iowa high 5 school athletic association, Iowa girls high school athletic 6 union, Iowa high school music association, or Iowa high school 7 speech association, not including post-regular season and 8 all-state contests or competitions. 9 2. A school district shall not charge a fee for the 10 admittance of a person eighteen years of age or younger to an 11 event. 12 3. The state board of education shall adopt rules that 13 calculate the amount of revenue that each school district 14 would have received if the school district charged fees for 15 the admittance of persons eighteen years of age or younger to 16 events based on budget enrollment as defined in section 257.6, 17 subsection 4. 18 4. a. Beginning July 1, 2022, there is appropriated 19 annually to the department from the sports wagering receipts 20 fund established under section 8.57, subsection 6, an amount 21 necessary to pay the amounts calculated pursuant to subsection 22 3. 23 b. The department shall distribute the moneys appropriated 24 pursuant to paragraph “a” to each school district in an amount 25 equal to the amount calculated pursuant to subsection 3 at 26 the same time and in the same manner as foundation aid is 27 paid under section 257.16, and may be included in the monthly 28 payment of state aid under section 257.16, subsection 2. 29 5. The moneys provided in this section shall be deposited 30 in the school district’s student activity fund established by 31 section 298A.8. 32 Sec. 2. Section 298A.8, subsection 1, Code 2022, is amended 33 to read as follows: 34 1. The student activity fund is a special revenue fund. 35 -1- LSB 5615SV (2) 89 dg/jh 1/ 3
S.F. 2306 A student activity fund must be established in any school 1 corporation receiving money from student-related activities 2 such as admissions, activity fees, student dues, student 3 fund-raising events, or other student-related cocurricular 4 or extracurricular activities , or moneys pursuant to section 5 279.76 . Moneys in this fund shall be used to support only the 6 cocurricular or extracurricular program defined in department 7 of education administrative rules. 8 Sec. 3. EMERGENCY RULES. The state board of education 9 may adopt emergency rules under section 17A.4, subsection 3, 10 and section 17A.5, subsection 2, paragraph “b”, to implement 11 the provisions of this Act and the rules shall be effective 12 immediately upon filing unless a later date is specified in the 13 rules. Any rules adopted in accordance with this section shall 14 also be published as a notice of intended action as provided 15 in section 17A.4. 16 Sec. 4. EFFECTIVE DATE. This Act, being deemed of immediate 17 importance, takes effect upon enactment. 18 Sec. 5. APPLICABILITY. This Act applies to school district 19 events occurring on or after July 1, 2022. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill relates to high school event admission fees for 24 people 18 years of age or younger. 25 The bill defines “event” as an extracurricular 26 interscholastic contest or competition authorized by the Iowa 27 high school athletic association, Iowa girls high school 28 athletic union, Iowa high school music association, or Iowa 29 high school speech association, not including post-regular 30 season and all-state contests or competitions. The bill also 31 defines “department” as the department of management. 32 The bill prohibits a school district from charging a fee for 33 the admittance of a person 18 years of age or younger to an 34 event. 35 -2- LSB 5615SV (2) 89 dg/jh 2/ 3
S.F. 2306 The bill requires the state board of education to adopt rules 1 that calculate the amount of revenue that a school district 2 would have received if the school district charged a fee for 3 the admittance of persons 18 years of age or younger to events 4 based on the school district’s budget enrollment. 5 The bill makes an appropriation beginning July 1, 2022, and 6 each year thereafter to the department of management from the 7 sports wagering receipts fund in an amount equal to the total 8 amount the state board of education has determined all school 9 districts would have received if school districts charged 10 people 18 years of age or younger admission fees to events. 11 The bill requires the department of management to distribute 12 all moneys appropriated to the department of management from 13 the sports wagering receipts fund relating to admission fees to 14 each school district in an amount equal to the amount the state 15 board of education has determined the school district would 16 have received if it charged people 18 years of age or younger 17 admission fees to events. Distributions shall be made at the 18 same time and in the same manner as foundation aid and may be 19 included in the monthly payment of state aid. 20 The bill allows the state board of education to adopt 21 emergency rules to implement the bill. 22 The bill takes effect upon enactment. 23 The bill applies to school district events occurring on or 24 after July 1, 2022. 25 -3- LSB 5615SV (2) 89 dg/jh 3/ 3
