S.F. 2298 Section 1. Section 29C.9, Code 2022, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 9A. The commission shall, if agreed to 3 by a two-thirds majority of the commission and a two-thirds 4 majority of the joint 911 service board, be responsible for the 5 activities of a joint 911 service board if substituted for a 6 joint 911 service board pursuant to section 34A.3, subsection 7 3A. 8 Sec. 2. Section 34A.3, Code 2022, is amended by adding the 9 following new subsection: 10 NEW SUBSECTION . 3A. Local emergency management commission —— 11 alternative to 911 service board. 12 a. Subject to section 29C.9, subsection 9A, a local 13 emergency management commission may be substituted for the 14 joint 911 service board required under subsection 1 by the 15 board of supervisors of the county in which the joint 911 16 service board is maintained. 17 b. A commission shall have all of the powers of a joint 911 18 service board if a commission is substituted for the joint 911 19 service board pursuant to paragraph “a” . 20 c. As used in this chapter, “joint 911 service board” 21 includes a commission if a commission is substituted for the 22 joint 911 service board pursuant to paragraph “a” . 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 This bill authorizes local emergency management commissions 27 to assume the duties of a joint 911 service board. 28 The bill provides that local emergency management 29 commissions may be substituted, if agreed to by a two-thirds 30 majority of the commission and a two-thirds majority of the 31 joint 911 service board, for a joint 911 service board by the 32 board of supervisors of the county in which the joint 911 33 service board is maintained. The bill establishes that, for purposes of Code 2 section 34A.3, “joint 911 service board” includes a commission 3 if a commission is substituted for the joint 911 service board. 4 The bill modifies the duties of a local emergency management 5 commission upon approval to be responsible for the activities 6 of a joint 911 service board if substitution occurs. 7 -2- LSB 5976SV (3) 89 es/rn 2/ 2
