S.F. 2291 Section 1. PARA-EDUCATORS HOLDING SUBSTITUTE AUTHORIZATIONS 1 —— 2021-2022 SCHOOL YEAR. 2 1. For the school year beginning July 1, 2021, a 3 para-educator certified under section 272.12 with a substitute 4 authorization may substitute in any classroom in grades 5 pre-kindergarten through twelve, except a driver’s education 6 classroom. 7 2. A school district shall make a good-faith effort to 8 employ a substitute teacher who is not a para-educator before 9 employing a para-educator for a position pursuant to subsection 10 1. A school district employing a para-educator as a substitute 11 pursuant to subsection 1 shall compensate the person at the 12 same rate as would be provided to a substitute teacher who is 13 not a para-educator for the same work. 14 3. The board of educational examiners may adopt emergency 15 rules under section 17A.4, subsection 3, and section 17A.5, 16 subsection 2, paragraph “b”, to implement the provisions of 17 this section and the rules shall be effective immediately upon 18 filing unless a later date is specified in the rules. Any 19 rules adopted in accordance with this section shall also be 20 published as a notice of intended action as provided in section 21 17A.4. 22 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 23 importance, takes effect upon enactment. 24 EXPLANATION 25 The inclusion of this explanation does not constitute agreement with 26 the explanation’s substance by the members of the general assembly. 27 This bill provides that for the school year beginning July 1, 28 2021, a certified para-educator with a substitute authorization 29 may substitute in any classroom in grades pre-kindergarten 30 through 12, except a driver’s education classroom. 31 The bill requires a school district to make a good-faith 32 effort to employ a substitute teacher who is not a 33 para-educator before employing a para-educator for a position 34 pursuant to the bill.
