S.F. 2212 Section 1. Section 151.9, Code 2022, is amended to read as 1 follows: 2 151.9 Revocation or suspension of license. 3 1. A license or certificate to practice as a chiropractor 4 may be revoked or suspended when the licensee or certificate 5 holder is guilty of the following acts or offenses: 6 1. a. Fraud in procuring a license. 7 2. b. Professional incompetency. 8 3. c. Knowingly making misleading, deceptive, untrue, or 9 fraudulent representations in the practice of the licensee’s 10 profession or engaging in unethical conduct or practice harmful 11 or detrimental to the public. Proof of actual injury need not 12 be established. 13 4. d. Habitual intoxication or addiction to the use of 14 drugs. 15 5. e. Fraud in representations as to skill or ability. 16 6. f. Use of untruthful or improbable statements in 17 advertisements. 18 7. g. Willful or repeated violations of the provisions of 19 this chapter or chapter 272C . 20 2. The board shall not revoke or suspend a license or 21 certificate to practice as a chiropractor for services provided 22 pursuant to section 169.4B. 23 Sec. 2. Section 169.4A, subsection 2, Code 2022, is amended 24 by adding the following new paragraph: 25 NEW PARAGRAPH . c. Apply to a chiropractor registered 26 pursuant to section 169.4B who is providing chiropractic 27 services to an animal. 28 Sec. 3. NEW SECTION . 169.4B Chiropractic services to an 29 animal —— registration. 30 1. The board shall grant a registration to a chiropractor 31 licensed pursuant to chapter 151 to provide chiropractic 32 services to an animal if all of the following requirements are 33 met: 34 a. The chiropractor submits proof of a current, valid 35 -1- LSB 5197XS (3) 89 ss/rh 1/ 3
S.F. 2212 license issued pursuant to chapter 151. 1 b. The chiropractor holds a current, valid certification 2 from the American veterinary chiropractic association. 3 c. The chiropractor submits an application in a form 4 prescribed by the board. 5 2. A registration issued pursuant to this section shall be 6 valid for three years. The board may impose a fee of twenty 7 dollars for the issuance and renewal of a registration pursuant 8 to this section. 9 3. The board, after due notice and hearing, may revoke or 10 suspend a registration issued pursuant to this section for any 11 reason that the board may discipline a veterinarian licensed to 12 practice veterinary medicine. The board shall not revoke or 13 suspend a person’s license to practice chiropractic. 14 4. The board shall adopt rules for the implementation 15 of this section, including a process for the receipt and 16 investigation of complaints. However, the board shall not 17 impose a fee pursuant to rule on a person who is registered 18 under this section. 19 5. Nothing in this section shall prohibit a veterinarian 20 licensed to practice veterinary medicine from providing 21 chiropractic services to an animal. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill relates to the provision of chiropractic services 26 to an animal by a person licensed to practice chiropractic. 27 The bill requires the board of veterinary medicine to grant 28 a registration to a person licensed pursuant to Code chapter 29 151 (chiropractic) to provide chiropractic services to an 30 animal if the person holds a current, valid certification from 31 the American veterinary chiropractic association, submits an 32 application to the board, and pays a fee of $20. The bill 33 prohibits the board from imposing any other fee pursuant to 34 rule. A registration to provide chiropractic services to an 35 -2- LSB 5197XS (3) 89 ss/rh 2/ 3

The bill does not prohibit a 1 person licensed to practice veterinary medicine from providing 2 chiropractic services to an animal. 3 The board of veterinary medicine may suspend or revoke a 4 registration to provide chiropractic services to an animal 5 for any reason for which the board may discipline a person 6 licensed to practice veterinary medicine. The bill prohibits 7 the board of chiropractic from revoking or suspending a license 8 or certificate to practice chiropractic for services provided 9 to an animal by a person registered to provide such services. 10 -3- LSB 5197XS (3) 89 ss/rh 3/ 3
