Section
1.
Section
321.11,
subsection
2,
Code
2022,
is

amended
to
read
as
follows:

2.
Notwithstanding
subsection
1
,
personal
information

shall
not
be
disclosed
to
a
requester,
except
as
provided
in
4
18
U.S.C.
§2721,
unless
the
person
whose
personal
information
5
is
requested
has
provided
express
written
consent
allowing
6
disclosure
of
the
person’s
personal
information.
As
used
in
7
this
section
,
“personal
information”
means
information
that
8
identifies
a
person,
including
a
person’s
photograph,
social
9
security
number,
passport
number,
driver’s
license
number,
10
name,
address,
telephone
number,
and
medical
or
disability
11
information
,
but
.
“Personal
information”
does
not
include
12
information
on
vehicular
accidents,
driving
violations,
and
13
driver’s
status
,
or
a
person’s
zip
code.

321.182,
subsection
1,
paragraph
a,
Code

is
amended
to
read
as
follows:

a.
Make
application
on
a
form
provided
by
the
department
17
which
shall
include
the
applicant’s
full
name,
signature,
18
current
mailing
address,
current
residential
address,
date
19
of
birth,
social
security
number
or
passport
number
,
and
20
physical
description
including
sex,
height,
and
eye
color.
21
The
application
may
contain
other
information
the
department
22
may
require
by
rule.
Pursuant
to
procedures
established
by
23
the
department
and
for
an
applicant
who
is
a
foreign
national
24
temporarily
present
in
this
state,
the
department
may
waive
the
25
requirement
that
the
application
include
the
applicant’s
social
26
security
number
or
passport
number
.

c,

The
department
shall
assign
an
applicant
for
a
driver’s

license
a
distinguishing
driver’s
license
number
other
than
the

security
number
and
passport
number
.

The
department
shall,
upon
application
and

issue
to
an
applicant
a
nonoperator’s

identification
card.
To
be
valid
the
card
shall
bear
a

distinguishing
number
other
than
a
social
security
number
and

passport
number
assigned
to
the
cardholder,
the
full
name,
date
4
of
birth,
sex,
residence
address,
a
physical
description
and
5
a
color
photograph
of
the
cardholder,
the
usual
signature
of
6
the
cardholder,
and
such
other
information
as
the
department
7
may
require
by
rule.
An
applicant
for
a
nonoperator’s
8
identification
card
shall
apply
for
the
card
in
the
manner
9
provided
in
section
321.182,
subsections
1
through
3
.
The
card
10
shall
be
issued
to
the
applicant
at
the
time
of
application
11
pursuant
to
procedures
established
by
rule.
An
applicant
for
a
12
nonoperator’s
identification
card
who
is
required
by
50
U.S.C.
13
app.
§451
et
seq.
to
register
with
the
United
States
selective
14
service
system
shall
be
registered
by
the
department
with
the
15
selective
service
system
as
provided
in
section
321.183
.

EXPLANATION
17
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
18
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
a
person
is
required
to
make
an
20
application
for
a
driver’s
license
or
a
nonoperator’s
21
identification
card
on
a
form
provided
by
the
department
of
22
transportation
(DOT).
The
person
must
provide
the
person’s
23
full
name,
signature,
current
mailing
address,
current
24
residential
address,
date
of
birth,
social
security
number,
and
25
physical
description
including
sex,
height,
and
eye
color.
The
26
DOT
may
waive
the
requirement
that
a
foreign
national
provide
a
27
social
security
number.
28
This
bill
authorizes
a
person
to
provide
the
person’s
29
passport
number
instead
of
the
person’s
social
security
number.

The
bill
allows
the
DOT
to
waive
the
requirement
that
a
foreign
31
national
provide
a
passport
number.
32
The
bill
makes
conforming
Code
changes
to
specify
that
a
33
person’s
passport
number
is
considered
personal
information
34
that
the
DOT
is
prohibited
from
disclosing
without
the
person’s
35

unless

by
law,
and
to
require
that

the
distinguishing
number
issued
by
the
DOT
on
a
person’s

driver’s
license
