S.F. 2114 Section 1. Section 321.234A, subsection 1, paragraph f, 1 Code 2022, is amended to read as follows: 2 f. The all-terrain vehicle is operated on a county roadway 3 secondary road in accordance with section 321I.10, subsection 4 2 , or a city street in accordance with section 321I.10, 5 subsection 3 . 6 Sec. 2. Section 321I.10, subsection 2, Code 2022, is amended 7 to read as follows: 8 2. A registered all-terrain vehicle or off-road utility 9 vehicle may be operated on the roadways of that portion of 10 county highways designated by the county board of supervisors 11 for such use during a specified period secondary roads . 12 The county board of supervisors shall evaluate the traffic 13 conditions on all county highways and designate roadways on 14 which all-terrain vehicles or off-road utility vehicles may be 15 operated for the specified period without unduly interfering 16 with or constituting an undue hazard to conventional motor 17 vehicle traffic. In designating such roadways, the board may 18 authorize all-terrain vehicles and off-road utility vehicles 19 to stop at service stations or convenience stores along a 20 designated roadway. 21 Sec. 3. Section 331.301, Code 2022, is amended by adding the 22 following new subsection: 23 NEW SUBSECTION . 21. A county shall not adopt an ordinance, 24 motion, resolution, or amendment, or use any other means, that 25 prohibits or regulates the operation of registered all-terrain 26 vehicles or off-road utility vehicles on secondary roads within 27 its jurisdiction, unless otherwise authorized by state law. 28 Sec. 4. Section 331.362, subsection 9, Code 2022, is amended 29 to read as follows: 30 9. A county may regulate traffic on and use of the secondary 31 roads, in accordance with sections 321.236 through 321.239 , 32 321.241 , 321.247 through 321.250 , 321.254 , 321.255 , 321.285, 33 subsection 4 , sections 321.352 , 321.471 through 321.473 , and 34 other applicable provisions of chapter 321 , chapter 321E , and 35 -1- LSB 5901XS (2) 89 th/ns 1/ 2
S.F. 2114 sections 321G.9 , 321I.10 , and 327G.15 . 1 EXPLANATION 2 The inclusion of this explanation does not constitute agreement with 3 the explanation’s substance by the members of the general assembly. 4 Under current law, a registered all-terrain vehicle (ATV) 5 or off-road utility vehicle (UTV) may be operated on a county 6 highway designated by the county board of supervisors for such 7 use during a specified period. The county board of supervisors 8 is required to evaluate the traffic conditions on all county 9 highways and designate roadways on which ATVs and UTVs may be 10 operated for the specified period without unduly interfering 11 with or constituting an undue hazard to conventional motor 12 vehicle traffic. In designating such roadways, the board is 13 allowed but not required to authorize ATVs and UTVs to stop 14 at service stations or convenience stores along a designated 15 roadway. 16 This bill allows registered ATVs and UTVs to operate on all 17 secondary roads (those roads under county jurisdiction). The 18 bill strikes the authority of a county board of supervisors 19 to regulate the operation of registered ATVs and UTVs and 20 prohibits a county from adopting an ordinance, motion, 21 resolution, or amendment, or using any other means, that 22 prohibits or regulates the operation of registered ATVs 23 and UTVs on secondary roads within its jurisdiction, unless 24 otherwise authorized by state law. 25 -2- LSB 5901XS (2) 89 th/ns 2/ 2
