S.F. 2076 Section 1. Section 483A.24, subsection 16, Code 2022, is 1 amended to read as follows: 2 16. a. Upon payment of the fee established by rules adopted 3 pursuant to section 483A.1 for a lifetime fishing license or 4 lifetime hunting and fishing combined license, the department 5 shall issue a lifetime fishing license or lifetime hunting and 6 fishing combined license to a resident of Iowa who has served 7 in the armed forces of the United States on federal active 8 duty and who was disabled or was a prisoner of war during that 9 veteran’s military service. The department shall prepare 10 an application to be used by a person requesting a lifetime 11 fishing license or lifetime hunting and fishing combined 12 license under this subsection . The department of veterans 13 affairs shall assist the department in verifying the status or 14 claims of applicants under this subsection . As used in this 15 subsection , “disabled” means entitled to a service connected 16 rating under 38 U.S.C. ch. 11 paragraph . 17 b. A resident of Iowa who has served in the armed forces of 18 the United States on federal active duty and who was disabled 19 may hunt without acquiring a hunting license, hunt or trap a 20 fur-bearing animal without acquiring a fur harvester license, 21 or fish without acquiring a fishing license. While hunting, 22 trapping, or fishing pursuant to this paragraph, the resident 23 shall, upon request of an officer of the department, display 24 proof of the veteran’s age, residency, veteran status, and 25 disability status. As used in this paragraph, “disabled” means 26 entitled to a service connected rating under 38 U.S.C. ch. 11. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 This bill relates to hunting, trapping, and fishing 31 privileges for certain disabled veterans. Under current law, a 32 resident who served in the armed forces of the United States on 33 federal active duty and who was disabled during that veteran’s 34 military service is eligible to obtain a lifetime fishing 35 -1- LSB 5069XS (5) 89 js/rn 1/ 2
S.F. 2076 license or a lifetime hunting and fishing combined license. 1 Under the bill, a resident who is a disabled veteran may hunt 2 without acquiring a hunting license, hunt or trap a fur-bearing 3 animal without acquiring a fur harvester license, or fish 4 without acquiring a fishing license. A resident hunting, 5 trapping, or fishing in such manner shall, upon request of an 6 officer of the department of natural resources, display proof 7 of the veteran’s age, residency, veteran status, and disability 8 status. 9 As a matter of law, a person who is not required to possess a 10 fishing license to fish is not required to pay a trout fishing 11 fee to fish for or possess trout. 12 -2- LSB 5069XS (5) 89 js/rn 2/ 2
