budget

one
or
any
combination
of
the
following
options,

determined
by
the
commission
,
except
as
provided
in
this

subsection

pursuant
to

Sec.
3.
Section
29C.17,
subsection
6,
Code
2022,
is
amended
13
to
read
as
follows:

6.
a.
Subject
to
chapter
24
and
paragraph
“c”
,
the
15
commission
shall
adopt,
certify,
and
provide
a
budget,
on
16
or
before
February
28
of
each
year,
to
the
funding
entities
17
determined
pursuant
to
subsection
2
.
18
b.
The
form
of
the
budget
shall
be
as
prescribed
by
the
19
department
of
management.

c.
Prior
to
adoption
and
certification
of
the
budget
to
be
21
provided
under
paragraph
“a”
,
the
commission
shall
mail
the
22
proposed
budget,
including
the
proposed
methods
and
sources
of
23
funding,
by
regular
mail
to
the
board
of
supervisors
and
the
24
city
council
of
each
city
within
the
county.
The
commission
25
shall
include
with
the
proposed
budget
notification
of
a
26
consultation
to
be
held
between
the
commission
and
the
board
27
of
supervisors
and
city
councils
prior
to
the
public
hearing
28
on
the
budget
under
chapter
24.
The
board
of
supervisors
and
29
each
city
council
shall
appoint
a
representative
to
attend
30
the
consultation
who
is
not
a
member
of
the
commission.
31
The
consultation
may
include
a
discussion
of
the
growth
32
in
the
proposed
budget,
if
any,
the
fiscal
impact
of
the
33
proposed
budget
on
the
county
and
each
city,
and
the
proposed
34
budget’s
estimated
impact
on
the
provision
of
services.

designated
representative
to
the
consultation
may
make
written

recommendations
for
modification
to
the
proposed
budget
no

later
than
seven
days
following
the
date
of
the
consultation.

The
commission
shall,
no
later
than
seven
days
prior
to
the

public
hearing
on
the
budget
under
chapter
24,
submit
a
written
5
response
to
the
board
of
supervisors
and
each
city
council
6
addressing
the
recommendations
for
modification
to
the
proposed
7
budget.

d.
Any
portion
of
a
tax
levied
by
a
county
or
city
to
9
support
the
local
emergency
management
agency
shall
be
10
identified
separately
on
tax
statements
issued
by
the
county
11
treasurer.

Sec.
4.
APPLICABILITY.
This
Act
applies
to
local
emergency
13
management
agency
budgets
for
fiscal
years
beginning
on
or
14
after
July
1,
2023.

EXPLANATION
16
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
17
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
budgets
of
local
emergency
management
19
agencies.
20
Code
section
29C.17(2)
specifies
the
methods
and
sources
for
21
funding
a
local
emergency
management
agency
and
provides
that
22
such
methods
and
sources
are
determined
by
the
local
emergency
23
management
commission.
The
bill
specifies
an
exception
to
the
24
commission’s
authority
by
providing
that
if
the
funding
source
25
is
a
countywide
special
levy,
the
use
and
amount
of
such
levy
26
must
be
approved
by
the
board
of
supervisors.

The
bill
amends
Code
section
29C.17(6)
relating
to
28
the
approval
procedures
for
a
local
emergency
management
29
agency
budget.
The
bill
requires
that
prior
to
adoption
30
and
certification
of
the
budget,
the
commission
mail
the
31
proposed
budget,
including
the
proposed
methods
and
sources
of
32
funding,
by
regular
mail
to
the
board
of
supervisors
and
the
33
city
council
of
each
city
within
the
county.
The
commission
