1.
Section
152C.3,
subsection
2,
paragraph
a,
Code

2022,
is
amended
to
read
as
follows:

(1)
Requirements
regarding
completion
of
at
least
twelve

hours
of
continuing
education
annually
regarding
subjects
4
concerning
massage
and
related
techniques
or
the
health
and
5
safety
of
the
public,
subject
to
reduction
by
the
board
if,
6
after
public
notice
and
hearing,
the
board
determines
that
the
7
welfare
of
the
public
may
be
adequately
protected
with
fewer
8
hours.

The
board
shall
allow
a
licensed
massage
therapist
10
to
include
each
hour
of
completed
training
required
pursuant
11
to
sections
232.69
and
235B.16
toward
the
annual
continuing
12
education
requirement.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
practice
of
massage
therapy.

The
bill
adds
licensed
massage
therapists
to
the
list
of
26
persons
required
to
report
child
and
dependent
adult
abuse.

By
operation
of
law,
such
persons
are
required
to
complete
28
training
regarding
the
identification
and
reporting
of
child
29
and
dependent
adult
abuse,
and
the
board
of
massage
therapy
30
is
required
to
require
the
completion
of
such
training
as
a
31
condition
of
licensure.
The
bill
allows
a
licensed
massage
32
therapist
to
include
the
completion
of
such
training
toward
the
33
fulfillment
of
the
continuing
education
requirement.

A
person
required
to
report
a
suspected
case
of
child
or

who
knowingly
and
willfully
fails
to
do

so
is
guilty
of
a
simple
misdemeanor.
A
simple
misdemeanor
is

punishable
by
confinement
for
no
more
than
30
days
and
a
fine
3
of
at
least
$105
but
not
more
than
$855.
A
person
required
to
4
report
suspected
child
or
dependent
adult
abuse
who
knowingly
5
fails
to
do
so
is
civilly
liable
for
the
damages
proximately
6
caused
by
such
a
failure.
