Section
1.
Section
321.20A,
Code
2022,
is
amended
to
read
1
as
follows:

321.20A
Certificate
of
title
and
registration
fees
——

commercial
vehicles.

1.
Notwithstanding
other
provisions
of
this
chapter
,
5
the
owner
of
a
commercial
vehicle
subject
to
the
apportioned
6
registration
provisions
of
chapter
326
may
make
application
7
to
the
department
or
the
appropriate
county
treasurer
8
for
a
certificate
of
title.
The
owner
of
a
commercial
9
vehicle
purchased
pursuant
to
section
578A.7
shall
present
10
documentation
that
such
sale
was
completed
in
compliance
11
with
that
section.
The
application
for
certificate
of
title
12
shall
be
made
within
thirty
days
of
purchase
,
or
transfer
,
13
delivery,
or
the
date
the
commercial
vehicle
is
first
driven
14
or
moved
upon
a
highway,
and
shall
be
accompanied
by
a
twenty
15
dollar
title
fee
and
the
appropriate
fee
for
new
registration.

The
department
or
the
county
treasurer
shall
deliver
the
17
certificate
of
title
to
the
owner
if
there
is
no
security
18
interest.
If
there
is
a
security
interest,
the
title,
19
when
issued,
shall
be
delivered
to
the
first
secured
party.

Delivery
may
be
made
using
electronic
means.

An
owner
of
more
than
fifty
a
commercial
vehicles
vehicle

subject
to
the
apportioned
registration
provisions
of
chapter

326
who
is
issued
a
certificate
of
title
under
this
section

shall
not
be
subject
to
annual
registration
fees
until
the
25
commercial
vehicle
is
driven
or
moved
upon
the
highways.
The
26
annual
registration
fee
due
shall
be
prorated
for
the
remaining
27
unexpired
months
of
the
registration
year.
Ownership
of
the
28
commercial
vehicle
shall
not
be
transferred
until
annual
29
registration
fees
have
been
paid
to
the
department.

Under
current
law,
the
owner
of
a
commercial
vehicle
subject

apportioned
registration
under
Code
chapter
326
must

transportation
or
the

appropriate
county
treasurer
for
a
certificate
of
title
within

30
days
of
the
purchase
or
transfer
of
the
vehicle.
The
fee
for

a
certificate
of
title
is
$20
and
must
be
accompanied
by
the
4
fee
for
new
registration.
An
owner
of
more
than
50
commercial
5
vehicles
subject
to
the
apportioned
registration
provisions
of
6
Code
chapter
326
who
is
issued
such
a
certificate
of
title
is
7
not
subject
to
annual
registration
fees
until
the
commercial
8
vehicle
is
driven
or
moved
upon
the
highways.

This
bill
allows
an
owner
of
a
commercial
vehicle
to
make
an
10
application
for
certificate
of
title
within
30
days
of
delivery
11
or
the
date
the
commercial
vehicle
is
first
driven
or
moved
12
upon
a
highway.
The
bill
strikes
the
50-vehicle
threshold,
13
thereby
providing
that
the
owner
of
any
number
of
commercial
14
vehicles
is
not
subject
to
annual
registration
fees
until
the
15
commercial
vehicle
is
driven
or
moved
upon
the
highways.
