S.F. 2036 Section 1. NEW SECTION . 624.21 Jury notification of 1 attorney funding. 2 Prior to deliberation, a civil trial jury shall be notified 3 if a party’s attorney’s compensation is contingent upon a 4 damages awards, the percentage of a damages award an attorney 5 will receive, and whether a litigation financier has provided 6 funding for the case. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill provides for jury notification of attorney 11 compensation and litigation financing. The bill requires 12 that the jury is informed of whether the attorney is being 13 compensated by a percentage of a potential damages award and 14 if there has been a litigation financier funding the case on 15 behalf of the party. 16 -1- LSB 5147XS (2) 89 cm/jh 1/ 1
